SEREMBAN - Seorang ahli perniagaan mengaku tidak bersalah di Mahkamah Sesyen di sini hari ini terhadap 75 pertuduhan menipu seorang lelaki membabitkan RM208,900 dengan menjanjikan mangsa akan dilantik sebagai calon Anggota Dewan Undangan Negeri (ADUN) negeri ini.

Tertuduh, Ibrahim Saidun, 60, didakwa memperdaya Rusman Sulaiman, 51, bahawa tertuduh yang bekerja sebagai Ketua Pengarah Unit Strategik di Jabatan Perdana Menteri dapat membantunya menjadi calon ADUN dan mendorong mangsa menyerahkan wang beberapa kali sejak 2011 hingga 2012.

7 Apr 2014 - Mereka menyertai sebuah persatuan silat di sekolah menengah sebagai sebahagian aktiviti kokurikulum, namun terkejut apabila seni mempertahankan diri itu menyebarkan dakyah songsang dengan mempertikaikan kebenaran al-Quran.

Apabila seorang daripada pelajar terbabit yang berusia 17 tahun menyanggah kenyataan itu, guru silat terbabit terus berang lantas melempar al-Quran sebelum memijak dan membakarnya.

Itu aduan diterima Jabatan Hal Ehwal Agama Islam Negeri Sembilan (JHEAINS) daripada seorang pelajar terbabit awal tahun ini dan menyiasat mengenai ajaran sesat yang disebarkan guru persatuan silat berkenaan.

Sumber JHEAINS berkata selepas menerima aduan daripada seorang daripada pelajar terbabit, pihaknya sudah menemui pengurusan sekolah berkenaan bagi membincangkan perkara itu awal bulan ini.

Menurutnya, siasatan awal mendapati lebih 10 pelajar sekolah itu menyertai persatuan silat di sekolah mereka sebagai aktiviti kokurikulum.

TIADA LAGI AMARAN ATAU MAAF! Sebaliknya hukuman serta-merta akan dikenakan terhadap mana-mana syarikat atau INDIVIDU yang didapati tidak memiliki lesen sah dan cuba menipu ketika menjalankan urus niaga dalam talian.

Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan (KPDNKK), Datuk Seri Hasan Malek, berkata ingatan itu sebagai menunjukkan pihaknya memandang serius peningkatan aduan daripada pengguna berkaitan salah laku dalam perniagaan terbabit.

"Sebab itu kita gesa pengguna, jika mahu beli barangan secara online (dalam talian), periksa dan semak dulu status syarikat sama ada ia sudah berdaftar dengan Suruhanjaya Syarikat Malaysia (SSM) atau tidak.

Selangor Government Should Bear Full Responsibility Over Lop-Sided Tropicana Land Deal

The ARTICLE by the Star "Khalid Caught off guard"  (March 29, 2014) indicated that Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim has erred in his call as the deal that the state had entered into with Tropicana Corp Bhd  exactly one year ago has returned to bite the back of the state government.

It was reported in several business dailies that under the deal, Tropicana acquired 1,172 acres from the state for RM1.3 billion to be paid over 20 years as the land is being developed. Under payment  terms, Tropicana had to fork out RM50 million as deposit and make two advance payments over a period of six months. The remaining is to be paid with interest over various schedules stretching over 18 years. However, since then Tropicana has sold out a portion of the land to Eco World Development Group Bhd for a cash payment of RM470.57 million.

This has now prompted Khalid on behalf of the state government to seek for an accelerated payment of RM844.2 million, as it is the opinion that it is the current value of the land.

However, neither does the agreement  restrict Tropicana from disposing a portion of the land to accelerate payment nor does it have to accelerate it payment to the state government as stated by the deal.

With the state government wanting the money back desperately and realising that the sale was a bad move, the Selangor state government, via Menteri Besar Selangor Inc, has made a fresh offer to Tropicana for the sale of the 1,297 acres of "Canal City" land on Friday.

This offer whereby Tropicana only needs to pay the net present value of RM844.3 million this time around compared with RM1.3 billion previously, which was supposed to be payable within 20 years.

Given the terms of the new deal which in my opinion heavily favours Tropicana and gives the perception that Selangor government could potentially lose millions of ringgit, the issue in contention would be how was the deal allowed to go through in the first place? How could the Menteri Besar allow any deal involving the state government to be signed with any party during the time when the state had a caretaker government in administration?  Who had signed the deal if it was not Khalid?

The state government should look into the matter seriously as it involves the rakyat's money. The Pakatan-Rakyat government has always been a proponent of competency, accountability and transparency since it was elected to power since 2008. If necessary a Selcat hearing should be held in the nearest time soon to identify those responsible for the agreement.

3 April 2014 - Bakal pelatih Program Latihan Khidmat Negara (PLKN) bagi kumpulan kedua yang diarah mendaftar masuk pada Sabtu hingga Isnin ini tetapi layak memasuki tingkatan enam, diwajibkan mengikuti program latihan itu terlebih dahulu.

"Setiap pelatih yang dipanggil harus hadir mengikuti latihan kerana selepas menamatkan PLKN, mereka boleh melanjutkan pelajaran ke tingkatan enam," katanya dalam sidang akhbar selepas mengadakan perjumpaan dengan kakitangan pengurusan dan jurulatih PLKN bagi Zon J di Kem Puncak Permai dekat sini semalam.

Katanya, penuntut yang sedang belajar di kolej atau universiti dibenarkan menangguhkan latihan tetapi tetap diwajibkan menjalani PLKN selepas itu.

PERTH: Perdana Menteri, Datuk Seri Najib Razak bimbang penculikan warga China di Semporna. Sabah yang dilaporkan hari ini mungkin perbuatan pihak tertentu untuk melagakan Malaysia dengan China selepas kejadian kehilangan pesawat MH370.

Beliau berkata demikian pada sidang media sempena lawatan kerjanya bagi meninjau operasi mencari MH370, di sini, hari ini.

Awal hari ini, media melaporkan seorang pelancong dari China dan seorang pekerja resort berasal dari Filipina dilarikan oleh sekumpulan lelaki di sebuah resort di Pulau Singgahmata, bersebelahan Pulau Bum-Bum di perairan Semporna, malam tadi.

PETALING JAYA: Penerbangan Malaysia Airlines (MAS) ke London terpaksa dijadualkan semula pada Khamis kerana masalah teknikal yang melibatkan pesawat.

Dalam satu kenyataan, syarikat penerbangan itu berkata penerbangan MH004 yang dijadual berlepas ke London pada jam 10.10 pagi telah ditunda atas sebab-sebab keselamatan.

"Oleh kerana keselamatan penumpang adalah keutamaan kepada syarikat penerbangan ini, penjadualan semula masa adalah perlu untuk memudahkan kerja-kerja membetulkan pesawat," kata kenyataan itu.

Penerbangan itu dijadualkan semula pada pukul 2.15 petang hari yang sama.

Sejak kehilangan MH370, terdapat beberapa siri kemalangan yang melibatkan pesawat termasuk kebakaran enjin dalam penerbangan Malindo, penerbangan MAS melanggar sekumpulan itik di Kathmandu dan penerbangan MAS ke Korea Selatan telah dialihkan ke Hong Kong selepas kegagalan generator pesawat.

PRESS STATEMENT BY MALAYSIAN PARLIAMENT CAUCUS ON SRI LANKA dated 27.3.2014

Members of the Caucus wish to inform the press and public that yesterday we have issued letters to the member states of the United Nations Human Rights Council ( UNHRC ), currently in session in Geneva, Switzerland, calling upon them to support a resolution on Sri Lanka which will be voted on by the UNHRC tomorrow Friday 28thMarch 2014.

We have sent the letter to the following countries:

INVESTIGATING HUMAN RIGHTS VIOLATIONS IN SRI LANKA


Greetings from Malaysia,


The undersigned are all members of the Malaysian Parliament and are also members of the Caucus on Sri Lanka in the Malaysian House of Representatives (Dewan Rakyat).


The Caucus was set up about two years ago and has been monitoring the situation in Sri Lanka. We observe that Sri Lanka has failed to implement the resolutions from their own Lessons Learnt and Reconciliation Commission, including the two resolutions passed by the UNHR Council in March 2012 and in 2013. We are also aware that a third resolution for an independent international investigation is expected to be voted on this coming Friday 28thMarch 2014 at the UNHRC 25th Session in Geneva.


We note with much regret and concern that serious violations of international law, widespread allegations of extra-judicial killings, sexual violence, enforced disappearances, continued militarization of the North East of Sri Lanka, land grabbing, failure to reach political solution, torture and violations of freedoms of expression, association and peaceful assembly all continue to be inflicted against Tamils particularly in the north and north east Sri Lanka. All these contravene the recommendations of both the UNHRC resolutions.


We are informed that the plights of the Tamils are getting from bad to worse. People are living in fear of rape, torture, abduction and many are leaving by boat as refugees. Even elected Tamil representatives are harassed.


The international community has the right, and carries also the responsibility, to establish responsibility for the war crimes and crimes against humanity committed in the Mullaivakkal War of May 2009, resulting in huge numbers of widows, orphans, tens of thousands still unaccounted for, and investigate why still tens of thousands are prevented from returning to their own homes and lands. In this context, credible allegations of a planned genocide of the Tamil community by the government of Sri Lanka persist and need investigation and clarification.

In the light of the above, we call upon your government as a member of the UNHRC to support the UNHRC resolution on Sri Lanka to be voted on Friday 28th March 2014 which calls for,
inter alia, a comprehensive independent investigation into serious violations and abuses of human rights and related crimes in Sri Lanka during the period covered by the Lessons Learnt and Reconciliation Commission with a view to establishing the facts and ensuring accountability for such crimes and avoiding impunity.

The rising tide of judicial impropriety, arrogance of power and transgression

"The bedrock of our democracy is the rule of law and that means we have to have an independent judiciary, judges who can make decisions independent of the political winds that are blowing." - Caroline Kennedy

 
Talking about political winds, it appears that lately, the Malaysian judiciary, particularly the judges of the superior courts, are caught in the whirlwind and are frantically racing against each other to please the powers that be of the day.

In the frenzy to curry favours from their political overlords, these minions have stopped at nothing to ensure that they will be the first to reach the finish line. Pots of gold await the backscratchers and lackeys. And where financial gratification may appear a tad blatant, there's always elevation to the higher rungs of office to whet the appetite. Unlike Parliamentarians, judges will never be content to be Back Benchers. The preferred place is the front and the top where they can tower over ordinary mortals, even if they be law-makers or members of the Bar. They fear no one except their political masters because they know on which side their bread is buttered. And they shall not bite the hand that feeds.

Throwing judicial decorum to the wind, they bare their fangs and sharpen their claws in order to cow supplicants in their courts into submission, and in the process, their demeanour and conduct leaves no one in doubt about their bias. And though they know that an adversarial system dictates that judges must not just act impartially but must be seen to be so, they bend backwards to don the hats of prosecutor and executioner as well. When this happens, as indeed it is happening now with unprecedented frequency, we know justice has gone to the dogs.

It is happening because Prime Minister Najib Razak, in flagrant abuse of power, has launched a new campaign of political persecution. "Even if we can't defeat them at the polls, all is not lost (remember Altantuya?). We still have our judges to do our bidding. See how they fall over each other at the snap of our fingers!"

This is the alarming trend in our judiciary where judges work hand in glove with the Attorney-General's Chambers to deny leaders of the Federal Opposition, duly elected representatives of the people in Parliament, their right to justice. In taking this unconstitutional and nefarious line, they have turned the doctrine of the separation of powers on its head.

Hence, apart from me, MPs Karpal Singh, Azmin Ali, Antony Loke, Rafizi Ramli, Tian Chua, Syed Azman and Shamsul Iskandar just to name a few, are marked for the judicial abattoir by the executioners. It may be sodomy, it may be sedition, or it may be illegal assembly, or whatever. These bootlickers know less of law and the principles of justice than lording over the courts parading proudly as peacocks (and peahens) their colourful judicial plumage overflowing with the arrogance of power.

As for those judges who used to sit on the throne, there is still life after retirement. The involvement of former Chief Justice Tun Abdul Hamid Mohamad in the National Unity Front, closely linked to Perkasa, Malaysia's icon of racism, while not shocking remains scandalous. It makes a mockery of the institution of the judiciary which he once headed and contradicts the principles of equality, equity and justice that the judiciary is supposed to stand for. Is it conceivable for a former chief judge to head an organisation that is adamantly opposed to the National Unity Consultative Council, and to be notoriously engaged in race-baiting and the trumpeting of the superiority of one race over other races in our multi-racial and multi-religious country?

It would appear that it is not only conceivable but that it is lauded with much fanfare by UMNO going by the prominent coverage given to it by the UMNO controlled media.

Incidentally, this is the same judge who, in his Federal court judgement, had written that "the court's decision must only be based on the evidence adduced and nothing else and (hence) it had to acquit because of lack of evidence," but qualified it with the illogical and manifestly asinine statement that "we find evidence to confirm that the appellants were involved in homosexual activities". In other words, "we find him NOT guilty but at the same time guilty". Anything more stupid, perverse and farcical than that cannot be found in our judicial annals (no pun intended) except for the judgements and pronouncements of Augustine Paul and Ariffin Jaka in respect of Sodomy 1 and the current decisions in respect of the application for expunging and the Sodomy 2 appeal. As they say, it has to take one stupid, perverse and farcical court to agree with another stupid, perverse and farcical court.

UMNO must fight its own political battles and not be such a coward to use the judiciary to help them fight the Opposition. How long more are our judges going to dance to tune of UMNO? When will they stop becoming stooges and lap dogs of UMNO leaders? How long more must the rakyat endure this sham? Who are the puppeteers in this shadow play? Are these judges not aware that UMNO will not be there forever to cover their tracks, or their backs, or that not only will history judge them, but that the rakyat are not going to sit idly by – forever – while they continue to pervert the course of justice?

Parliament, as the vox populi, must make its voice heard before we reach the tipping point and the situation gets out of our hands. There is a tide in our affairs which, unless we seize it, will see our voyage for democracy and rule of law in shallows and in miseries. This is the rising tide of judicial impropriety, arrogance of power and transgression. As one of the three branches of government, Parliament must reassert the sanctity of the separation of powers principle. It is therefore morally incumbent and constitutionally expedient that Parliament acts accordingly to break up the illegal and unconstitutional collusion between the Executive and the Judiciary.

Conviction of Muslim Brotherhood members – A death sentence on justice

In the most farcical and disgraceful trial in modern history, the
Egyptian military junta under Dictator General al-Sisi, on Monday
sentenced to death 529 leaders and politicians of the Muslim
Brotherhood.

Most of the countries in the Arab world, with the notable exception of
Qatar, have neither lifted a finger nor said a word of protest against
this even as the EU and the USA have at least expressed some token
regret. Shamefully, the speaker of the Malaysian Parliament, no doubt
taking orders from the Najib administration, refused to allow the
matter to be debated in spite of vehement demands from the Opposition.

Following the military coup by al-Sisi and the scandalous sacking and
arrest of democratically elected President Morsi, Egypt has gone from being the darling of the Arab Spring to undisputed pariah state of the free world.

This latest act in a series of illegal, unconstitutional and morally
despicable acts by the military junta since the power grab underscores
the diabolical nature of the new Egyptian government set up
purportedly to restore “justice, freedom and democracy” that was
alleged to have been eroded under the administration of duly-elected
President Morsi.

On the contrary, the new regime has demonstrated beyond the shadow of
a doubt that it has no qualms about using the organs of state power
such as the army, police and the judiciary to oppress and repress the
Egyptian people. The fundamental liberties and human rights
safeguarded under the Morsi administration are thrown the drain.
Hundreds more political opponents are jailed without trial while
international journalists including three from al-Jazeera, are
detained without due process.

Backed by a well-orchestrated and sustained media campaign to
whitewash its actions, the ruthless regime of al-Sisi has massacred
its own people including women and children and unleashed other
atrocities with complete impunity.

Monday’s verdict to execute 529 opponents of the coup in a summary
trial that lasted less than an hour makes an utter mockery of the
judicial process and leaves no one in doubt that it is justice itself
which has been given the death sentence and that due process has been
sent to the firing squad instead.

The Egyptian people had paved the way for the full blossoming of the
Arab Spring when, with their blood, sweat and tears, they overthrew
Husni Mubarak, ending four decades of military dictatorship. Voted to
power via an internationally recognised electoral process, President
Morsi and law makers from the Brotherhood and other political parties
were slowly but surely steering the country to new directions in the
path of freedom, democracy and justice.

Tragically, the blatant coup last July engineered by al-Sisi, working
hand in glove with corrupt external powers, has turned the clock back.
The military powers that be appear to believe that this latest
crackdown on the Brotherhood, following the earlier outlawing of the
movement, will further weaken them.

In this regard, they are gravely mistaken. History has shown that
people who are pushed to the ground by perverse and prolonged acts of
oppression and injustice will emerge even stronger.

Condolences: Irene Fernandez

Azizah and I mourn the passing of Irene Fernandez, a champion of the weak, the poor and the marginalized, and a fighter of true grit in the face of persecution and constant harassment by the authorities.

This is truly a great loss to the nation and to Keadilan, she being one of co-founders.

Indeed, also a sad personal loss as she had been a close family friend and my colleague since our Malaysian Youth Council days.
