Indraf 2.0 Berhimpun Suarakan Sokongan Kepada Pakatan

Kumpulan Indian Rights Action Force (Indraf 2.0) hari ini berhimpun bagi menyuarakan sokongan terhadap kepimpinan Pakatan Rakyat (PR) memandangkan pilihan raya umum semakin hampir.

Himpunan tersebut yang turut dihadiri pemimpin tertinggi PR seperti Ketua Pembangkang Datuk Seri Anwar Ibrahim, itu juga memperlihatkan kepimpinan PR cuba untuk meraih sokongan pengundi India ekoran penganalisis dan pemerhati politik sebelum ini menyatakan sokongan komuniti tersebut telah kembali kepada Barisan Nasional (BN) ekoran transformasi yang dilaksanakan pentadbiran Perdana Menteri Datuk Seri Najib Razak.

Himpunan di Girl Guides Hall yang bermula jam 3 petang di Brickfields di sini dan dijangka berakhir jam 8 malam ini turut melihatkan kehadiran Lim Kit Siang, Ahli Parlimen Lembah Pantai, Nurul Izzah Anwar, serta kepimpinan tertinggi PR yang lain.

Menurut penganalisis politik tanah air, polisi-polisi Najib yang dilihat lebih baik berbanding polisi yang diamalkan perdana menteri sebelum ini telah berjaya meraih kembali sokongan pengundi India selepas sokongan mereka berpindah kepada pembangkang pada 2008.

Mengulas berkenaan perhimpunan tersebut, Naib Presiden PKR, Nurul Izzah Anwar dalam kenyataannya kepada The Malaysian Insider berkata, "PR akan merombak semula polisi ekonomi dalam Dasar Ekonomi Baru (DEB) bagi memenuhi kehendak dan keperluan masyarakat India di negara ini."

Jelas Izzah lagi, Indraf turut menyerahkan memorandum sokongan terhadap PR, yang mana bertujuan untuk mengubah pentadbiran negara ini dan membebaskan pentadbiran daripada belenggu politik perkauman.

"Indraf menyerahkan memorandum kepada kami dengan harapan kepimpinan negara perlu diubah bagi mengelakkan politik perkauman," katanya lagi.

Sementara itu, Timbalan Ketua Menteri (II) Pulau Pinang Dr P. Ramasamy yang hadir dalam perhimpunan tersebut melihat sokongan rakyat India kepada PR semakin kukuh dan turut menepis dakwaan media BN yang menyatakan masyarakat India sudah kembali menyokong mereka.

"Itu mainan media BN. Saya yakin masyarakat India menyokong penuh kepimpinan PR.

"55 tahun memerintah BN tak mampu menyelesaikan masalah masyarakat India seperti — masalah berkaitan kad kelahiran, kad pengenalan, masalah mendapatkan biasiswa dalam pendidikan, dan masalah dalam meningkatkan ekonomi masyarakat India." tambahnya kepada The Malaysian Insider.

Beliau yakin segala masalah komuniti India di negara ini akan beroleh penyelasaian melalui kepimpinan PR dan masyarakat India menolak untuk menyokong MIC atau mana-mana parti yang mewakili masyarakat India selain PR.

"Kami sudah tidak percayakan mana-mana parti India lagi temasuk MIC. Kami letakkan kepercayaan penuh kepada Pakatan untuk membantu masyarakat India," katanya dan menambah "Indraf akan bergabung dengan Pakatan dalam pilihan raya akan datang."

Perhimpunan Indraf 2.0 hari ini menyaksikan kehadiran hampir 2,000 peserta daripada seluruh negara adalah projek NGO Suara Masyarakat India Malaysia yang diketuai oleh Timbalan Ketua Menteri (II) Pulau Pinang Dr P. Ramasamy, Presiden National Interlok Action Team, Datuk Thasleem Ibrahim dan bekas tahanan Akta Keselamatan Dalam Negeri (ISA) V. Ganabatiraodan R. Kengadharan.

Sepanjang perhimpunan tersebut berlangsung, turut kelihatan anggota polis di sekitar kawasan Brickfield bagi mengawal keadaan lalulintas.

Ketua pembangkang Datuk Seri Anwar Ibrahim berkata Perdana Menteri Datuk Seri Najib Razak secara tidak langsung membiarkan tindakan ganas dilakukan ke atas ceramah Pakatan dengan tidak mengutuk tindakan tersebut.

Katanya, Najib secara tidak langsung membiarkan tindakan tersebut ketika apabila perdana menteri tidak membuat kenyataan supaya perkara seperti itu dihentikan.

Najib juga melepaskan tanggungjawabnya dengan bertindak demikian, kata Anwar lagi ketika ditemui pemberita di Klang petang ini.

Siri serangan yang mensasarkan ceramah Pakatan Rakyat semakin menjadi-jadi seperti yang berlaku di Gambang (Pahang), Merlimau (Melaka) dan terbaru di Lembah Pantai (Kuala Lumpur yang menyebabkan sekurang-kurangnya tiga orang cedera.

Ditanya mengenai dakwaan Umno bahawa beliau yang mencetus pergaduhan di Lembah Pantai ketika ceramah pada Khamis malam itu, Anwar dengan sinis berkata mangsa dalam kejadian tersebut, seorang lelaki yang sudah berumur, mungkin cedera akibat perbuatan sendiri.

Malah ketika cermin keretanya dipecahkan, beliau juga memecahkannya sendiri, kata Anwar lagi.

Ops Scorpene 2.0: SUARAM Tells of Envelope With Sub-Folder Entitled “C4″

Earlier this week, a newspaper in Hong Kong ran an expose’ of the Scorpene submarines scandal implicating Prime Minister Najib Razak, his close friend Razak Baginda and murdered Mongolian translator Altantuya Shaariibuu.

In the news report, which was picked up by several Malaysian blogs, Najib was portrayed as the main culprit behind the conspiracy to skim a huge commission from the Malaysian government’s purchase of the 2 submarines from French arms maker DCNS.

He was also implicated in the Altantuya murder, for which two of his former bodyguards have been sentenced to hang while Baginda was controversially acquitted.

The HK newspaper also reported that the French courts had summoned Najib to testify as witness in the corruption trial filed by Malaysian NGO SUARAM against DCNS.

The 28-year-old Altantuya, believed to have been lovers with both Najib and Baginda, was portrayed as a translator who was killed for her role as a middleman in the case, in which Najib and Baginda have been accused of collecting an illegal kickback worth more than RM500 million.

She was shot in the head in a jungle clearing in Malaysia in 2006 and her body bombed with military-grade C4 explosives to prevent identification.

More funds needed to nail the culprits

Meanwhile, SUARAM has announced that it will be launching Ops Scorpene 2.0 to raise funds to fight DCNS in the French courts. It has issued the statement below.

“SUARAM hopes that with the commencement of the Submarine case in France, we can send a clear message that Malaysians will not sit back and accept corrupt politicians and rampant corruption activities in Malaysia.

The submarine commission scandal, one of the greatest Malaysian robberies in modern times, is not a single one-off issue but reflects the widespread abuse of the Barisan Nasional administration with spiraling dominos effects, on how tax payers monies have been used and abused.

SUARAM is a human rights organization, known to speak out fearlessly in defence of human rights, good governance and an open and accountable society. We pursued the court case to seek truth and justice for the Malaysian people whose monies have been misused. For over 20 years SUARAM has worked to expose corrupt practices, poor governance and champion the rights of people before profits.

So to continue the struggle to unravel the scandals behind the submarine purchase, and in pursuance of the ongoing case in France, SUARAM needs much help and donations from people of Malaysia. This campaign needs to continue without any interference and with the full support of the Malaysian people. Costs are very high and will remain that way for the next few years until the case is disposed off and the truth unraveled, once and for all.”

Second fundraising campaign

Ops Scorpene 2.0 is a second fundraiser and awareness campaign (the first was in July 2011) to further pursue and to bear expenses of the case in the French courts, which has escalated to become a huge issue of national interest.

It seeks to instill consciousness amongst Malaysians to question arms spending and transparency in arms procurement of the country.

The dinner will be held on 15 June 2012, 7.30 pm at Dewan Sivik MBPJ, Petaling Jaya, Selangor. Ops Scorpene aims to raise RM300, 000 from this fundraising dinner and to bear the legal fees of the lawyers who are working to ensure the success of the case.

Cynthia Gabriel from SUARAM, Joseph Breham, one of the 2 French lawyers, and political leaders like Saudara Mat Sabu, Members of parliament Tian Chua and Tony Pua will address the latest developments surrounding the case.

There will also be a number of performances and booths for NGOs to get their message and campaign forward (scroll below for details of event).

How it began

On the 5th June 2002, the Malaysian Government signed an agreement with French DCNS and Spanish Navantia for the procurement of two Scorpene class submarines. The procurement contract was through direct negotiation with the manufacturing companies, said to be with the service of Perimekar Sdn Bhd. Razak Baginda is the owner of Perimekar.

According to the Government explanation, the contract was divided into two parts:

Cost of two Scorpene submarines together with the package that covers Integrated Logistic Support and training amounted to Euro 969.15m (however on 14 May 2008, Najib told the Parliament that this part cost Euro 999.15)

Payment to Perimekar Sdn Bhd in the name of "coordination services" for a period of six years, the sum was Euro 114.96m.

With the exchange rate at the time, the cost was equivalent to:

Payment for submarine cost between: RM 2.14b (Euro=RM3.2 in 2002) – RM 5.43b (Euro=RM5.6 in 2008) (now Euro=RM4.7)

Commission: probably about RM 540m (exchange rate at the time of payment)

Complaint filed in the hope of initiating a probe

On 23 December 2009, SUARAM through its networks in France linked up with leading human rights lawyers in France, to file a complaint with the French judicial system, with the hope that a preliminary investigation would be initiated. This was done to enable access to information, to the government contracts signed with PERIMEKAR and other information classified as government secrets in Malaysia.

In April 2010, the lawyers representing SUARAM informed that the courts had accepted the request to investigate the claim of corruption for a payment amounting to Euro 114 million made as commissions from DCNS to Perimekar.

The French, practising the Civil Law system where a judge assumes the role of an inquisitorial and investigative referee, has so far kept the findings of its investigations confidential.

SUARAM lawyers however, have informed that the investigation is coming to an end, and should move to full trial after it decides whether or not there is sufficient evidence to pursue the matter in open court.

On 16 March 2012, the French courts have opened an inquiry into the alleged corruption, misuse and abuse of taxpayer's money, linked to the purchase of the 2 Scorpene class submarines, back in 2002.

First degree court: Witnesses including Najib proposed

An inquiry into the alleged corruption, misuse and abuse of taxpayers money, linked to the purchase of the two Scorpene class submarines, back in 2002 commence on 19 April 2012 (Thursday) at the Paris Tribunal de Grande Instance (TGI), known as a first degree court that deals with civil litigation matters. This investigation will be conducted before two judges, Judge Roger Le Loire and Judge Serge Tournaire.

On 20th April SUARAM was represented by Dr. Kua Kia Soong (Director and one of the founders of SUARAM), followed by Cynthia Gabriel (Secretariat Member) and lawyer Fadiah Nadwa. They appeared before Judge Roger Le Loire with their lawyer Joseph Breham.

Dr Kua presented the case for SUARAM, pinning its hopes on the judicial hearing in France after the disappointing trial over the Altantuya murder, the ineffectual MACC, the suppression of information in Malaysia and the lack of transparency in the parliamentary questions over the Scorpene commissions.

SUARAM duly proposed then Defence Minister and current Prime Minister Najib Razak, Abdul Razak Baginda, the defence minister Zahid Hamidi, PI Balasubramaniam, Setev Shariibuu, Jasbir Singh Chahl, Tan Sri Lodin and Mazlinda as the potential witnesses as the case proceeds.

On 3rd May 2012, SUARAM revealed that it has gained full access to investigation papers from the Public Prosecutor's office. This is a huge step forward, as many of the details kept confidential are now made accessible to SUARAM as the Plaintiff in the civil case against the DCNS. French law provides several constraints on the area of access. While SUARAM was not able to obtain a hard copy and distribute copies around, it is however entitled to a full view of the documents and is able to quote from them to the media and to the public.

New findings

At the PC SUARAM revealed new expose and findings on:

Document 87

The documents seized by the French police from the office of Mr. Henri GIDE (THALES) on 28 May 2010 which includes a fax written in English and sent by F. DUPONT dated 1 June 2001 addressed to D. ARNAUD, CCed to BAIOCCO and SAUVAGEOT with "MALAYSIA/SUBMARINE PROJECT" as the subject. Mr. DUPONT detailed out the chronology of visits and future actions during the journey in Malaysia of which there were various planned undertakings in particular negotiation meetings with the Ministry of Defense and the management members of PERIMEKAR during which two (2) contract proposals would be mentioned (from DCNI to PERIMEKAR as well as between PERIMEKAR and the Malaysian Government). He finally indicated a meeting with DATO' SRI NAJIB in France on 14 July 2001 with the condition that DCNI offers a maximum sum of USD 1 billion for PERIMEKAR's stay (in France).

Envelope with sub-folder entitled ‘C4′

The prosecutor's office upon instructions had received from THALES International Asia, an envelope on 22 August 2011. The envelope contained:

- A sub folder entitled "C4"

- A sub folder entitled "invoices"

- PDF files

- A USB thumb drive

Among the crucial documents was the existence of an invoice faxed by TERASASI Sdn Bhd (Company No.524814-P) on 19 September 2004 to Bernard BAIOCCO the then CEO of THALES International Asia. The invoice stated an amount of Euro 359, 450.00 for the purpose of success fees to be paid to Alliance Bank Malaysia Berhad, Branch CP Tower, Seksyen 16, Petaling Jaya, Account No:12109-0-01-3000450-8 and contains a handwritten note in French as follows:

"Razak demande si ce SF peut etre pris en compte assez vite. Le Support Fee suit avec un rapport".

Translation : Razak requests if that SF can be taken into account quite urgently. The support fee follows with a report.

Beneficiaries- Najib and Baginda?

It therefore appears that Thales International Asia could not ignore that the sum paid to TERASASI Sdn Bhd ultimately benefitted Mr Najib Razak the Minister of Defence and/or his consultant Abdul Razak Baginda.

It has become apparent that this constitutes one of the Malaysian government's greatest robberies over its people! It is no longer just the Euro 114.9 million commissions to Perimekar that formed the basis of the complaint to the French Courts that is in question.

It has magnified into a web of lies involving a slew of companies formed to complicate the concealment of the blatant robbery of Malaysian and French tax-payers' money. More retro-commissions have surfaced allowing the misuse of such bodies as the pilgrimage funds (Lembaga Tabung Haji) and the military pension funds (Lembaga Tabung Angkatan Tentera).

92% Rakyat Mahu Daftar Pemilih Dibersih Sebelum PRU

Satu kajiselidik yang dibuat baru-baru ini – sehari sebelum perhimpunan BERSIH 3.0 -  menunjukkan majoriti responden mahu daftar pemilih dibersihkan sebelum pilihan raya umum akan datang.

Menurut Merdeka Centre, 92 peratus daripada 1,019 orang yang dikajiselidik bulan lalu berkata kerajaan perlu melakukannya sebelum pilihan raya umum.

Keputusan itu hampir sebulat suara di kalangan responden pelbagai bangsa, kumpulan umur, jantina, pendapatan dan kawasan, dengan lebih 90 peratus daripada setiap kumpulan, menjawab dengan positif.

Kira-kira separuh atau 48 peratus daripada kumpulan yang sama juga berkata mereka tidak yakin dengan daftar pemilih.

WSJ Editors Misunderstand Malaysian Politics

The Wall Street Journal published an editorial on on May 24, 2012 titled "Malaysian People's Court". In it the influential newspaper challenges Opposition Leader Anwar Ibrahim to admit to committing "civil disobedience" at the April 28 Bersih Rally and accept the consequences of that action.  The paper says rather cynically "If Mr. Anwar wants to practice civil disobedience, he can't pretend to be innocent at the same time."

The Wall Street Journal seems to believe that the primary purpose of the gathering on April 28 was to protest the Public Assembly Act, which states in Section 4(2)(c):

"a person commits an offence if he organises or participates in a street protest."

It's clear however that the April 28th demonstration has nothing to do with the Public Assembly Act, just like the previous BERSIH rallies in 2011 and 2007 had nothing to do with the predecessor laws to the Peaceful Assembly Act that restricted public assembly in Malaysia and presumably rendered those public gatherings technically illegal under Malaysian laws. The April 28th demonstration had the stated purpose of protesting electoral fraud. Subsumed within that protest are a whole litany of laws that prevent free expression and assembly of Malaysians.

What exactly did Anwar do that is illegal? Currently he has been charged with violating the Public Assembly Act and pleading not guilty. What legal tradition does the WSJ belong to that suggests an accused must prove himself innocent when charged with a crime?

Such an upside down approach to the law is usually the modus operandi of the Malaysian Attorney General, where politically motivated trials place the burden of proof on the defendant and not the prosecution in a true perversion of the justice system.

If indeed Anwar Ibrahim was engaged in an act of civil disobedience by participating in the April 28th BERSIH Rally then so too were the 200,000 other Malaysians gathered in downtown Kuala Lumpur, not to mention the thousands of others who demonstrated throughout the country. Why is Anwar Ibrahim and his two associates the only ones to be charged by the government? And why would the WSJ place the lions share of responsibility on Anwar Ibrahim and not BERSIH chairperson herself Ambiga Srenavasan?

Additionally, if the BERSIH gathering was deemed legal but it was the breaching of the barriers at Dataran Merdeka in particular that are considered the illegal act which Anwar was expressing civil disobedience over, then the WSJ's point is also fundamentally flawed. Anwar has denied giving any instructions for people to breach the barrier and in fact the extended video of him near the barrier shows he tried to get the people to disperse, rather than cross the barrier.

A legitimate, independent investigation needs to be conducted to figure out what happened. The likely conclusion will be that those near the barrier were dead set on crossing over and prepared to face the consequences. There was no mechanism for Anwar, Ambiga or anyone else to control that sentiment. However, it's also clear that a truly independent inquiry is virtually impossible in Malaysia and even when inquiries do happen, their results are ignored.

So why then should Anwar plead guilty to an act of civil disobedience when 1) he was not expressing civil disobedience but rather demonstrating in support of electoral reform and 2) when doing so would necessarily land him in jail or with a fine that would disqualify him from contesting in the upcoming general election?

Is now the time for Anwar to willingly banish himself to prison or to the political wilderness just to prove a point that the opposition is willing to adhere to the rule of law in a country where the laws are themselves fundamentally flawed. Is the Wall Street Journal trying to make a point that Malaysia is a reformed nation now and that both government and opposition should be held to the same high standard of adhering to the rule of law?

What laws are we talking about here? Whose laws? The Public Assembly Act was forced through parliament just like all of Najib Razak's so called reform measures. They are in each case an example of giving some rights out with their right hand and taking away a series of other rights with their left hand. The net effect is pretty much zero. Is the WSJ drinking the Kool-Aid that Najib's administration is mixing with the help of well paid international media consultants, including some journalists formerly employed by the WSJ?

Instead the WSJ should have read the latest polling results from the Merdeka Center that show 90% (i.e. virtually all) of Malaysians want to see the electoral roll cleaned before the next election and that nearly half of all Malaysians do not have faith in the integrity of the electoral process. There are also a large percentage of Malaysians, Malays in particular, who remain unclear about the stated goals of the BERSIH movement. Presumably, if given the chance to be informed and educated, a large percentage of these people will also question the integrity of the electoral process.

Is this not the real story that the WSJ missed by zeroing in on Anwar's act of civil disobedience? The fact that an election is likely to take place in Malaysia within the next 11 months in the midst of the revolutions of the Arab Spring and the return to public office of Aung Sun Sii Kyi where 50% of voters do not believe in the integrity of the process and are thus likely to question the integrity of the counting and results?

Yang dituntut oleh rakyat ialah penyelesaian skandal KLIA2 yang bernilai RM3.9 billion, skandal RM12.5 billion PKFZ dan skandal RM12.49 bilion lebihan kos projek landasan keretapi berkembar EDTP.


Tetapi yang dibuat oleh Menteri Pengangkutan Datuk Seri Kong Cho Ha ialah mendabik dada kerana berjaya menjadi penjual nombor plat kenderaan WWW.

Inilah kehebatan seorang Menteri dari MCA dan Barisan Nasional yang diamanahkan oleh negara untuk menjaga kepentingan rakyat, kata Setiausaha Publisiti DAP Tony Pua.

"Rakyat Malaysia tidak perlukan seorang Menteri Pengangkutan yang cuma berminat melaporkan jumlah lelongan nombor plat WWW daripada menyelesaikan isu besar yang dihadapi," katanya dalam satu kenyataan.

Menurutnya, Kong tidak berwibawa kerana gagal melindungi dan mempertahankan kepentingan awam melibatkan isu skandal berbilion ringgit, sebaliknya, beliau telah mengadakan beberapa sidang akhbar bagi mengumumkan nilai rekod bidaan tertinggi bagi plat kenderaan WWW yang mencecah RM11.3 juta seperti mana yang dilaporkan Bernama.

Pua yang juga Ahli Parlimen Petaling Jaya Utara berlata, Kong sepatutnya menjelaskan kepada rakyat tentang kenaikan mendadak nilai "terminal kos rendah" KLIA2 dari RM1.7 billion pada 2007 kepada RM3.9 billion tahun lalu adalah akibat penukaran tapak KLIA2 ke kawasan paya gambut.

"Walaubagai mana pun, kenaikan RM2.2 billion tersebut yang membebankan rakyat dijawab Kong yang hanya berkata 'saya tidak mempunyai jawapan kerana keputusan tersebut tidak dibuat oleh Kementerian Pengangkutan', " tambah beliau.



PLKN wajib kpd semua pelajar lepasan sekolah menengah?

Ramai pihak menolak cadangan mewajibkan semua pelajar lepasan sekolah menengah menyertai Program Latihan Khidmat Negara (PLKN).Beberapa pertubuhan pendidikan, ibu bapa dan pelajar memberikan pelbagai sebab mengapa mereka tidak bersetuju dengan cadangan Pengerusi Majlis Latihan Khidmat Negara (MLKN), Datuk Dr Tiki Lafe.Dr Tiki pada Khamis berkata, cadangan itu telah dibincangkan oleh MLKN dan akan diusulkan kepada kerajaan untuk persetujuan selain meminta maklum balas dari orang ramai.


"Jika ia dipersetujui, kira-kira 500,000 pelatih akan terlibat untuk satu tahun. Oleh itu, kami akan mengkaji kemudahan sedia ada sama ada ia perlu diperluaskan untuk menampung pertambahan peserta," katanya.

Bagaimanapun, Ketua Setiausaha Kementerian Pertahanan, Datuk Seri Ismail Ahmad berkata, agak sukar untuk menempatkan kesemua lepasan sekolah menengah kerana program itu boleh menampung sekurang-kurangnya 90,000 pelatih setiap sesi pengambilan.

"Kita akan memilih pelatih secara rambang untuk ditempatkan di 79 kem seluruh negeri. Agak sukar menempatkan kesemua lepasan sekolah menengah kerana jumlahnya hampir setengah juta," katanya pada Jumaat.

Pengerusi Persatuan Ibu Bapa Untuk Pendidikan Malaysia (PAGE), Datin Noor Azimah Abdul Rahim berkata, orang ramai tidak akan bersetuju dengan cadangan tersebut sehingga kemudahan di kem latihan dipertingkatkan.

"Sehingga perkara melibatkan keselamatan boleh dijamin, program tersebut tidak boleh diwajibkan," katanya.

Ibu bapa turut menyatakan rasa bimbang mengenai keselamatan, kesihatan dan kebersihan.

"Kem latihan yang disertai anak saudara saya mencatatkan kes buli paling tinggi," kata Karen Wong, 48, yang turut memiliki seorang anak lelaki di Tingkatan 5. Lawrence Liu, 53, yang mempunyai anak perempuan di Tingkatan 4 berkata, program itu berdepan dengan masalah keselamatan.

"Terdapat banyak kes kematian berlaku. Apabila pelatih sakit, tiada perhatian secukupnya diberikan," katanya.

Pelajar Tingkatan 4, Amin Haikal Ahmad, 16, dari SMK Sultan Sulaiman, Kuala Terengganu berkata, program tersebut mempunyai masalah imej.

"Saya terdengar pelbagai cerita mengerikan dari beberapa kem latihan…saya tidak mahu menyertai program itu walaupun niatnya baik," katanya.

Nur Fatin Syahmi Aqilah Mohd Ghani, 16, berkata, kerajaan perlu menggalakkan pelajar lepasan sekolah menengah menyertai program sukarelawan berbanding memaksa mereka menyertai program PLKN.

Kerajaan Negeri telah mengarahkan semua ahli-ahli majlis PBT, ketua-ketua Komuniti Kaum India, NGO untuk membantu membawa mereka-mereka untuk mendaftar pada hari tersebut

Lebih 20 orang sukarelawan telah ditugaskan untuk mengambil butiran mereka pada hari itu

Setelah selesai, butiran pendaftaran tersebut akan dikumpul dan kemudiannya dihantar ke Kementerian Dalam Negeri (KDN) untuk proses seterusnya.

Dijangkakan lebih 5,000 orang akan hadir dan mendaftar pada hari tersebut

Menghulurkan Bantuan Kepada Mangsa Ribut Kampung Jawa

Pada satu kejadian ribut yang melanda dalam kawasan DUN Sri Andalas baru-baru ini, dua buah rumah telah mengalami kerosakan teruk.

Kejadian pada kira-kira jam 3 pagi pada 17 Mei yang lalu menyebabkan dua rumah tersebut yang terletak di Lot 6221 batu 1 1/2 Kampung Jawa telah kehilangan bumbung akibat diterbangkan oleh ribut.

Mangsa kejadian iaitu Rodziah Nordin dan Razali Nordin bagi kedua-dua rumah tersebut telah datang berjumpa YB Dr Xavier Jayakumar, ADUN Sri andalas meminta bantuan.

Atas tanggungjawab dan keprihatinan, bantuan RM1,000 telah diberikan kepada setiap mereka bagi membaiki bumbung rumah mereka yang rosak.

Kerja-kerja membaiki bumbung rumah telah dijalankan dan disiapkan yang dikoordinasi oleh Ketua Kampung, Tuan Haji Ismail.







Lebih 300 Ibu Diraikan Pada Majlis Hari Ibu di Kuil Rajarajeswari Taman Sentosa

Taman Sentosa, 22 Mei 2012 - Lebih 300 wanita bergelar ibu diraikan dalam satu majlis Hari Ibu yang diadakan pada hari ini di Kuil Rajarajeswari di Taman Sentosa.

Seramai 12 orang ibu tertua dikalangan lebih 300 dipilih untuk diberikan penghormatan dengan 'shawl' dan 'malai' serta diberi sari sebagai hadiah.

YB Dr Xavier Jayakumar yang juga ADUN Sri Andalas telah mengadakan upacara memotong kek bersama-sama mereka dalam majlis meraikan golongan ibu tersebut.

Sementara itu, lebih 300 ibu yang lain diberikan 'goody bag' dan dalam majlis yang sama seramai tiga orang telah diberi sumbangan kerusi roda.

Para hadirin kemudiannya menikmati hidangan makan malam sayur-sayuran bersama-sama.
Majlis Hari Ibu ini telah dianjurkan oleh Pejabat DUN Sri Andalas dan diuruskan oleh Encik Satthia Seelan bersama-sama para petugas DUN Sri Andalas.

Aren’t We Already in a State of Lawlessness?

Regardless of its terms of reference, the people will have to contend with the independent panel to investigate violence during the Bersih 3.0 rally that has been handpicked by the government. And we may have to wait a little while before judging whether the panel is fair or biased, or simply redundant.

This is in view of the attorney-general’s pre-emptive moves in charging several people under the Peaceful Assembly Act 2012, as well as having advised the government to sue the Bersih steering committee for damages.

The investigations, or any other action pertaining to Bersih 3.0, should have been put on hold once the government announced the formation of the said independent panel. Similar action was taken during the black eye incident, when I was instructed to put investigations on hold the moment the cabinet announced the setting up of the RCI. Abdul Gani Patail is fully aware of this precedent.

Be as it may, the impartiality of the panel has been a subject of contention since its formation was announced, particularly the appointment of Hanif Omar as the chairperson. The test of their impartiality will be whether the panel is willing to raise the issue on the position of Gani Patail, to whom the panel’s findings will be submitted for a decision.

Where goes the panel report?

Although many will disagree, but if there is need for a panel to investigate Gani, then I suggest that both Hanif and retired Chief Justice of Borneo Steve Shim are the most appropriate persons to be in that panel. I am also of the view that Gani’s antics cannot get past these two distinguished gentlemen.

For the benefit of all, this is Steve Shim’s decision on Gani’s conduct in Zainur Zakaria vs PP [2001] 3 CLJ:

“In the circumstances, was he (referring to Anwar Ibrahim) not justified, on a prima facie basis, in complaining that the AG’s (Gani Patail’s) conduct at the meeting on 2 October 1998 was an attempt to get Nalla to fabricate evidence in order to perfect charges against him (Anwar) for other alleged sexual offences?”

The former CJ is expected to defend his decision on the above and he will certainly be backed by Hanif, who knows the truth of what exactly happened in 1998 and how the facts were manipulated and by whom. Particularly now, since the panel’s report will eventually be scrutinised by none other than Gani himself.

The government of the day, then and now, cannot deny being fully aware of Shim’s decision on Gani. The government must recognise the former CJ’s decision in the same manner Dr Mahathir takes cognisance of another Federal Court decision, as found in his memoir A Doctor in the House (page 695):

“Most Malaysians are ignorant of the contents of the judgment of the Federal Court, which acquitted Anwar on a technicality due to the error relating to the date of the incident. They are not aware that the majority of the Federal Court had held that in their judgment they found ‘…evidence to confirm that the appellants (Anwar and Sukma) were involved in homosexual activities and we are more inclined to believe that the alleged incident at Tivoli Villa did happen’…”

No one saw Anwar sodomise Sukma or anybody else, or having sex with any woman. The Federal Court came to that conclusion merely relying on evidence gathered or manufactured by Musa Hassan and presented before the judges by Gani and his prosecution team.

But where falsification and fabrication of evidence are concerned, several people saw what Gani did. Musa Hassan and Dr Rahman Yusof not only saw it but were parties to it, willingly or otherwise. Another pathologist from Hospital Kuala Lumpur testified in court that Anwar’s blood sample for DNA tests was stolen from the doctor’s custody on Oct 15, 1998.

Over and above that, I not only saw with my own eyes what Gani did, but I went to the extent of warning him of the complications that could be expected in the near future when he (Gani) is discovered, besides telling him of the stern instructions and warning from the prime minister himself, whom I briefed on Oct 8, 1998, that there should not be any cover-up in the investigations involving Anwar Ibrahim. Most importantly the products of the falsifications are available for all to see.

One important question immediately comes to mind: Which of the two Federal Court decisions cited above should be given more weight? It must be noted that Shim’s decision on Gani came first.

Does that mean that if the court decides against Anwar, then the decision is said to be correct or is in the right direction, but when a court decides in favour of Anwar, then the court is wrong or the judge has a political agenda or may be labelled as a communist sympathiser?

If Shim’s decision on Gani is not given its due weight nor respected by the government of the day, then Shim should not be allowed to remain on the panel. Should the government have some decency to accept a legitimate judicial decision of the highest court of the country, then Gani should henceforth be suspended and made to face the due process.

The government of the day must explain how on earth was Gani Patail, despite allegations of having a tainted resume, chosen to be the attorney-general in 2002 and how such conduct could have escaped the Yang di-Pertuan Agong’s scrutiny.

Ulterior motives involved?

Either the government had ulterior motives or the government was simply negligent in exercising due care in vetting Gani’s suitability and competency before he was recommended to be appointed as the AG.

Either way ,the Agong was deceived into believing that Gani Patail was the most suitable and not encumbered with any criminal culpability if compared with at least two other candidates. The Agong would not have appointed Gani had he not been so deceived.

Former Yahoo CEO Scott Thompson was fired just four months after his appointment, for merely allowing two inaccuracies on his qualifications to appear in his biodata that was filed with the securities regulators – one in accounting and the other in computer science.

It was not about qualifications he didn’t have. It was all about honesty. If a CEO can cheat about his qualifications, then he can cheat about everything else pertaining to the affairs of the company.

Similarly, if the EC chairperson and his deputy can deceive the Conference of Rulers and the Agong with no feelings of remorse, then they can cheat on everything and anything concerning the electoral roll.

If our government copied the American model of gerrymandering, then it should also adopt their model of testing the honesty of the EC chairperson, as the Americans did with the former Yahoo CEO.

One must also not forget that Musa Hassan was reported to have committed perjury during a trial in 1998 by claiming to have a qualification that he did not, just like Scott Thomson. The only difference between them is that Thompson was caught once and given the boot, while Musa was caught three times in all and yet cleared of any wrongdoing.

If Gani Patail, who has a damning decision on his head and a preponderance of evidence in several other allegations of wrongdoings, can still be allowed to remain in office and carry on with his illegitimate ways of doing things;

If both the EC chairperson and the deputy are said to have secured their positions through fraud and misrepresentations and by concealing their present or previously held membership in a political party and yet are allowed to remain as custodians of the electoral roll;

If the prime minister himself, who could be proven to have affirmed false affidavits in September 2011 and knowingly filing the same in a High Court to avoid having to give his testimony before the said court and yet nothing was done by the appropriate authorities, then;

Are we not in a state of lawlessness already? No?

Belia Penggerak Kebangkitan Masa Depan

Kelab Anwar Ibrahim (AIC) percaya pada Marcapada, peredaran zaman memerlukan belia untuk mengharungi kehidupan dengan lebih cergas dan proaktif. Arus pemodenan ketika ini diperderas dengan memaksimumkan minda ke tahap yang lebih kritis. Belia harus mengambil peluang dalam arus ini untuk bangun dan bawa perubahan kepada negara.

Banyak informasi yang dapat dimanfaatkan belia dipaparkan dalam media massa, tentang kebobrokkan dan kezaliman oleh pemerintah kepada rakyat. Di seluruh dunia, terutama di Mesir, yang menjadi penggerak utama kepada naik dan jatuhnya sesebuah kerajaan. Belia adalah nadi kepada negara, pasak yang mendukung aspirasi negara, malah Imam Syafie pernah menyebutkan, "Jika mahu lihat masa depan sesebuah negara, lihat anak mudanya sekarang"

Selari dengan ayat daripada al-Quran, surah al-Kahfi, menjelaskan (13)

"Kami ceritakan kepada engkau cerita mereka dengan sebenarnya. Sesungguh-nya mereka itu adalah pemuda-pemuda yang beriman kepada Tuhannya, dan Kami beri mereka tambahan pimpinan" disambung dengan ayat berikutnya (14) "Dan Kami teguhkan hati mereka, ketika mereka berdiri dan berkata: Tuhan kami ialah Tuhan langit dan bumi, kami tiada memuja selain daripada-Nya. (Kalau kami sembah selain Allah), tentulah kami mengatakan perkataan yang salah."

AIC meyakini pencerapan daripada kedua-dua ayat tersebut adalah, anak muda harus menjadi kental, harus keras dan berani untuk tolak kezaliman, tolak rasuah, jangan takut kerana Tuhan pasti bersama orang yang benar. Jiwa anak muda yang taat kepada agama sudah tentu akan menitik beratkan integriti dan nilai yang positif. Tidak harus ada kegoyahan kepada ugutan dan kekerasan yang dilontarkan penzalim.

Pastinya ramai anak muda yang tidak menyedari hakikat tentang hak-hak mereka yang diabaikan kerana terleka dengan 'keselesaan' palsu yang dihidangkan kerajaan Barisan Nasional. Adakah itu jenis anak muda yang ingin dihasilkan oleh Malaysia?

Anak muda harus berada di barisan hadapan, menjadi 'whistle blower' didalam negara, iaitu menjadi penggera kepada setiap perkara yang memberi impak buruk kepada negara. Hingga satu tahap, selayaknya anak muda bakal dijadikan kayu pengukur kepada kecemerlangan negara.

Selain itu anak muda harus meletakkan idea mereka pada tahap yang boleh dibanggakan, merebut peluang untuk jawatan penting dalam komuniti, kerana sudah menjadi norma masyarakat di Malaysia yang hanya menerima pendapat dan idea daripada individu yang berpengaruh atau berjawatan. Menjadi sia-sia apabila sebuah idea yang bagus menjadi kurang kredibilitinya kerana individu yang melontarkan idea itu tidak berpengaruh atau berjawatan.

Terutama dalam isu jaminan kehidupan, kestabilan dan keselesaan belia, sekalian anak muda telah muak dengan pelan jangka masa pendek yang dihulurkan oleh sang kapitalis yang akhirnya menjerut leher anak muda, sebagai contoh PTPTN. Asalnya sebagai pelan untuk membantu anak muda untuk belajar, namun modus operandinya adalah untuk mengaut keuntungan dan menguntungkan kapitalis. Anak muda yang baru menamatkan pengajian membawa pulang gulungan sijil beserta setimbun hutang yang akhirnya akan melambatkan tingkat hidup anak muda.

Oleh itu, AIC menggesa agar semua anak muda untuk bangkit dan tolak kezaliman demi membebaskan jiwa dan naluri anak muda. Bangkit menentang kezaliman pemerintah. Isu anak muda bukan sahaja berkisar di PTPTN, AUKU yang menyekat pemikiran mereka, menyekat kebebasan anak muda untuk menyuarakan pandangan mereka tetapi juga kesengsaraan sekeliling yang meruntun perasaan . Jiwa anak muda memang fitrah mereka (seperti yang disebutkan dalam surah al-Kahfi) untuk menolak segala bentuk penindasan.

AIC melihat segala bentuk program yang dianjurkan oleh kerajaan Barisan Nasional di Himpunan Jutaan Belia 2012 sebagai tidak mencerminkan pembentukkan belia yang kita impikan untuk masa depan negara. Kejahilan dan kematangan akal tidak boleh bergerak seiring, maka penganjuran sesebuah program yang "berniat" baik tidak akan mencapai sasaran dengan pengisian aktiviti yang menjurus ke arah lara dan melalaikan.

Justeru AIC menyeru agar semua belia menjadi ejen perubahan yang akan menganjak pemikiran dan daya anak muda ke satu tahap yang lebih dihormati bukannya menjadi penerus pada sisi gelap yang memperbodohkan minda dan mencengkam perlakuan belia sehingga kehilangan kehebatannya.

Kawasan lapang peneroka tidak akan selamat apabila Felda Global Venture Holdings (FGVH) disenaraikan di Bursa Malaysia, kata PKR.

Pengarah Strategi PKR Rafizi Ramli mendakwa, sebaik sahaja peneroka hilang kawalan terhadap FGVH, tiada apa lagi yang dapat menyekat syarikat itu daripada mengambil alih tanah terbuka atau rumah kedai di kawasan Felda.

Walaupun tanah 10 ekar dan tanah yang dimiliki peneroka tidak dapat disentuh, tetapi kawasan tanpa geran tanah boleh diambil, dakwanya.
