DNA Specialist McDonald to Testify

After Australian forensic pathologist Dr David Wells testified yesterday, another foreign expert, DNA specialist Dr Brian McDonald, will take the witness stand in the Sodomy II trial involving Oppostion Leader Anwar Ibrahim.

McDonald, who is also from Australia, will first answer questions from defence lawyer Ram Karpal and this is likely to take most of the morning.

It will follow with cross-examination solicitor-general II Mohd Yusof Zainal Abiden, who is lead prosecutor.

Wells was quizzed by Yusof for most parts of yesterday. In his testimony, Wells said that a 30-year-old study stating that sperm retrieved from the rectum can last up to 65 hours should be treated with caution.

At one point, the witness was briefly stumped when asked how a third person could retrieve another person’s sperm and planted in the alleged victim’s rectum. He said he would leave it to a DNA expert to answer that question.

Later, in replying to questions from defence lawyer Sankara Nair, Wells agreed there could be tear in Mohd Saiful Bukhari Azlan’s rectum should the purported act – as described by the complainant – was “laju and rakus” (fast and furious).

Pusrawi Hospital’s Dr Mohamed Osman Abdul Hamid and Hospital Kuala Lumpur doctors have earlier testified that they saw no signs of injury.

Pakatan Beri PM, SPR Peluang Terakhir

Pakatan Rakyat hari ini memberi Perdana Menteri dan Suruhanjaya Pilihan Raya peluang terakhir bagi membuktikan komitmen mereka berhubung pembaharuan pilihan raya, sebelum gabungan itu memutuskan sama ada untuk memboikot jawatankuasa khas parlimen berhubung isu itu.

Pada sidang akhbarnya, hari ini, Ketua Pembangkang, Datuk Seri Anwar Ibrahim berkata keputusan muktamad akan dibuat pada Oktober nanti.

“Kita belum buat sebarang keputusan untuk memboikot tetapi menjelaskan bahawa kerajaan perlu menunjukkan niat baik dengan Suruhanjaya Pilihan Raya mengambil tindakan segera, dan PM menunjukkan beliau serius dengan menjamin pilihan raya hanya akan diadakan selepas SPR telah mengambil langkah sewajarnya.

“Kita ada beberapa minggu lagi sebelum Ramadan berakhir dan diikuti dengan Aidilfitri… satu atau dua minggu untuk berfikir. Menjelang bulan depan, kita akan tentukan," katanya.

Hadir sama dalam sidang akhbar itu ialah timbalan presiden PAS, Mohamad Sabu yang berkata, bagi membuktikan komitmennya, SPR hendaklah segera membuat empat perubahan yang dituntut oleh BERSIH 2.0, antaranya menggunakan dakwat kekal, melanjutkan tempoh berkempen dan yang terpenting membersihkan daftar pemilih.

Katanya, ini tidak memerlukan pembentukan jawatankuasa khas parlimen yang dijangka dibentuk pada sidang parlimen Oktober ini.

Dalam perkembangan yang lain, Anwar berkata Majlis Pakatan Rakyat juga bersetuju mendesak Menteri Dalam Negeri, Datuk Seri Hishammuddin Tun Hussein menjelaskan isu pemberian “kewarganegaraan segera” kepada penduduk tetap.

“(Setakat ini) tidak ada langsung jawapan jelas dari menteri dalam negeri itu, bagi mengurangkan kebimbangan (rakyat),”katanya.

Sehubungan itu, Anwar berkata, Pakatan Rakyat mencadangkan supaya suruhanraja diraja ditubuhkan segera bagi menyiasat isu berkenaan.

The opposition pact has still not decided on whether to join the parliamentary select committee on electoral reform announced by Prime Minister Datuk Seri Najib Tun Razak on Aug 15.

Opposition leader Datuk Seri Anwar Ibrahim instead wants the prime minister to give the assurance that the next general election will only be held after the Election Commission has undertaken reforms of the election process.

“Under the existing law, there is no problem for the EC to take immediate action to resolve issues involving the electoral roll and election process,” Anwar said after chairing the opposition pact’s leadership council meeting at the PAS headquarters, here, Wednesday.

Among those present were PAS deputy president Mohamad Sabu and DAP adviser Lim Kit Siang.

Najib had said that the setting up of the PSC was to remove suspicions of manipulation of election results by the government. The PSC is to be headed by a minister and to include nine parliamentarians comprising five from the ruling government, three from the opposition and an independent.

Anwar, who is also Permatang Pauh member of parliament, said the opposition had not made a decision on the matter but denied that it was boycotting the PSC.

“We still have a lot of time, and we (opposition pact) will be meeting again after Aidilfitri,” he said.

Ex-US Ambassador’s Disclosures Show Up Malaysia’s ‘Dirty Politics’

Prime Minister Najib Razak and wife Rosmah Mansor have a lot to answer to. Already overflowing in scandal over massive corruption and ordered by the court to testify in Opposition Leader Anwar Ibrahim’s sodomy trial, for which he has accused them of plotting, a former US ambassador has dropped a bombshell.

John Malott, now the president of the Japan-America Society of Washington DC, was in charge of the mission in Kuala Lumpur from 1995 to 1998. He told of how Najib had struck an alliance and understanding with Anwar, who was then deputy prime minister, and how Najib later betrayed Anwar.

Both leaders were from the ruling party UMNO, whose members were then restless and unhappy with the ham-fisted ways of Mahathir Mohamad, the prime minister who ruled Malaysia from 1981 to 2003.

“When I was in KL, Najib's personal think tank was called the Malaysian Strategic Research Centre, or MSRC. MSRC basically was two people, Rohanna Mahmood and Razak Baginda. Rohanna told me that Najib and Anwar had reached a secret agreement. When Mahathir was gone, Anwar would be PM and Najib would be Deputy PM. That was the deal,” John Malott wrote in his article published in Malaysia Chronicle on Tuesday.

“That never happened, of course. When the going got tough, Najib stood by, and let Anwar go to jail.”

Indeed, sensing a shift in the wind, the wily Mahathir gathered together his trusted lieutenants including former Finance minister Daim Zainuddin and slapped on sodomy and graft charges against a stunned Anwar, who was then the darling of the Malay community and UMNO grassroots. This was the modus operandi Mahathir was accused of using to nip in the bud potential attempts by Anwar to challenge him at upcoming party elections.

Nuked until he could never stand up again

Malott revealed even more shocking information in his article entitled Malott drops a bombshell: A secret pact between Najib and Anwar.

Razak Baginda, who years later acted as a negotiator for Najib in the RM7 billion Scorpene submarines purchase, told a US embassy staff that a decision had been made to “nuke” Anwar until he could “never stand up again politically."

Baginda told a senior Embassy officer, "The decision has been made. They are going to "nuke" Anwar politically for all time to come. "Until he can never stand up again politically."

After that, a senior officer in the Special Branch told an Embassy officer, "We are going to keep filing charge after charge after Anwar so he will be in jail for the next hundred years."

“Can there be any doubt about what was going on then – and what is going on now?” said Malott, describing the onslaught by Anwar’s enemies as a “political decision”.

The ex-Ambassador’s startling revelations rang a bell for Chua Jui Meng, who in the late 1990s, was the BN Health minister.

“Yes, I remember Malott, he was a very active ambassador. He visited me in my ministry and never struck me as being pro-Anwar. He gave a lot of time to the other departments in the government as well. There was no reason to be pro-Anwar anway. I think Malott is cheesed off at what’s happening now because this took place when he was around and was privy to a lot of top-level information,” Jui Meng, now a PKR vice president, told Malaysia Chronicle.

“But I am glad that he has spoken up and made public the information he had at his disposal. This will help to inject some justice into our very skewed system and put some perspective in the anti-Anwar propaganda churned out by the mainstream media on a daily basis. That is wholly unfair. What I can share with you is that Najib has always been someone who swings with the wind and win. And that says it all.”

Treachery most vile

However, Najib not only stood by, letting Anwar remain in jail and getting beaten up by a senior cop keen to please Mahathir, 10 years later in 2008, he and wife Rosmah had a ‘chat’ with a young man called Saiful Bukhari Azlan.

Two days after meeting Najib, who was then deputy prime minister and very anxious to sit in the PM’s chair, Saiful lodged a police report, accusing Anwar of sodomising him. It was a reprsal of the script Anwar accused Mahathir of writing in 1998, in which he had been accused of sodomising his wife’s driver. From prime minister-in-waiting, Anwar lost everything. His family was forced to shift out of their government quarters and he was forced to spend the next 6 years in jail.

It was only after Mahathir retired that the country’s federal court dared to overturn the manifestly fabricated sodomy charges against him.

But not only has history repeated itself in 2008, Najib too appears to have succumbed to the same dark forces that had guided Mahathir.

“Ask around Umno circles and you will hear this too. Najib has never been known to be loyal nor decisive. His political history is chequered with betrayals and opportunism beginning with his betrayal of Tengku Razaleigh in 1987,” PKR strategy director Rafizi Ramli told Malaysia Chronicle.

“Najib will say anything to secure the post he wants, so I am not surprised by Malott’s disclsoure. It was an open secret. Everybody knew Mahathir sought Najib’s support after sacking Anwar and Najib let Anwar down even though he was part of Anwar’s Wawasan 2020 team. That is why he nearly lost his Pekan seat in the election after that.”

Indeed, when defending himself against the second-round of sodomy charges, Anwar said as much during open court on Monday.

"This entire process is nothing but a conspiracy by Prime Minister Dato' Seri Najib Razak to send me into political oblivion by attempting once again to put me behind bars. I therefore declare that I have no faith whatsoever that justice will prevail in these proceedings notwithstanding the valiant efforts made by my defence team. As I have said at the outset, this is not a criminal trial. It is a charade staged by the powers that be to put me out of action in order that they remain in power."

Sperma Tidak Mungkin Ditemui Dalam Rektum Selepas 90 Jam – Sankara

Peguam Datuk Seri Anwar Ibrahim, Sankara Nair hari ini menegaskan sekali lagi beliau menolak penemuan DNA sperma dalam rektum pengadu, Mohd Saiful Bukhari Azlan, hampir 90 jam selepas ia dibawa ke makmal.

Sankara membuat kenyataan itu sewaktu membidas hujah Peguam Cara Negara II, Datuk Yusof Zainal Abiden yang memetik  kertas kajian daripada United Kingdom yang diterbitkan hampir 30 tahun dahulu, iaitu pada tahun 1982.

Yusof memetik kajian  itu dalam soal balasnya terhadap saksi pembelaan, pakar patologi forensik dari Australia, Dr David Wells pagi tadi.

Ketua pendakwaraya itu mendakwa kajian itu mendapati DNA sperma boleh ditemui dalam rektum manusia selepas hampir 65 jam air mani dilepaskan ke dalam rektum.

Sankara yang mengulangi kembali kenyataan Pakar Patologi Forensik Australia, Dr David Wells di dalam mahkamah, berkata eksperimen yang dirujuk Yusof itu dilakukan dalam keadaan terkawal.

Malah, penemuan yang sama tidak lagi berlaku kerana Dr Wells sendiri sepanjang profesionnya tidak berjaya menemui sebarang sperma selepas lebih 48 jam ia dikeluarkan.

"Ada satu eksperimen dalam makmal yang dijalankan dalam keadaan terkawal. Mereka menemui sperma selepas 65 jam sperma berada di dalam rektum.

"Namun, selepas eksperimen itu, tiada lagi sebarang penemuan yang mengesahkan perkara itu.

"Satu kes sahaja, tidak mewakili semua kes.

"Itu pun dalam eksperimen terkawal," kata Sankara.

Menurut Sankara, ia berbeza dengan keterangan Saiful yang mendakwa dirinya diliwat dan pada masa yang sama melakukan pelbagai aktiviti yang boleh menyebabkan kualiti sperma yang didakwa berada di dalam rektumnya merosot.

Malah, DNA sperma dari tubuh Saiful juga hanya dianalisa di makmal lebih daripada 90 jam selepas kejadian liwat didakwa berlaku.

"Di sini kejadian liwat didakwa berlaku. Dan sperma ditemui 90 jam selepas kejadian didakwa berlaku?! Tidak mungkin.

"Tetapi di sini pendakwa raya mendakwa menemui sampel sperma yang bagus (dalam dubur Saiful)," kata Sankara.

Justin Smith Steps Down From FBC Media board

Ben Smith and I report on the main site how The Atlantic has become the latest media company to get tangled in the scandal surrounding FBC Media, a British company on whose board Atlantic Media Co. President Justin Smith sat until the bad press moved him to resign.

The Atlantic is the latest media organization to launch an internal investigation into its connections with a British company that has provided editorial content on foreign subjects while doing public relations work for some of the same governments it was reporting on, a spokeswoman acknowledged to POLITICO.

In addition to the internal review, the magazine also said Justin Smith, president of Atlantic Media Co., has resigned from the board of FBC Media, the firm at the center of a controversy over whether it improperly mixed its journalism and PR businesses. It was Smith who connected FBC Media with The Atlantic.

The disclosure that FBC Media had a contract with the Malaysian government at the same time it was producing positive television segments about Malaysia for CNBC, BBC and other major broadcasters, led CNBC and BBC to pull all FBC Media-produced content and launch their own internal investigations in the past month.

The Atlantic is in a similar position because FBC Chairman Alan Friedman blogged about governments that may have been current or onetime FBC Media clients in his dispatches for The Atlantic from the World Economic Forum in Davos in January. Friedman also approached The Atlantic about hosting an event featuring his client, Malaysian Prime Minister Najib Razak. The event, held in March, was moderated by Atlantic national correspondent James Fallows.

Smith has sat on FBC Media's board since 2007. He told POLITICO on Sunday that he informed Friedman two weeks ago of his desire to step down and was in the process of formalizing the request when POLITICO asked about it.

"The truth is that Alan Friedman has been a friend of mine for nearly twenty years," Smith said. "In light of this friendship and my past association with the company, I am very disturbed to learn of the serious allegations being raised about FBC and Alan's conduct. What I would particularly regret, should these accusations directed at FBC be proven true, is my role in having introduced Alan to The Atlantic's editors and event planners.

"I have directed a full review of The Atlantic's dealings with him, and the responsibility at The Atlantic for any problems it might uncover will be mine. It is my job to safeguard at all costs The Atlantic's reputation for editorial integrity."
