Petronas Found Wanting in Global Transparency Study

The national oil and gas company Petronas has scored below average in an international study on revenue transparency and public disclosure, which covered 44 oil and gas companies worldwide.

According to the 2011 Report on Promoting Revenue Transparency in Oil & Gas companies, published today by Transparency International (TI) and Revenue Watch Institute (RWI), Petronas performed badly in all three key sections.

These are ‘Reporting on Anti-Corruption Programme’, ‘Organisational Disclosure’ and ‘Country-Level Disclosure for International Operations’.

Ppetronasetronas’ respective scores were 30, 38 and zero percent, compared with the average scores of 43, 65 and 16 percent.

UK’s BG Group, India’s Oil and Natural Gas Corporation and Norway’s Organisational Disclosure and Statoil, topped the three sections respectively with scores of 93, 100 and 69 percent.

Petronas was ranked in the bottom 25 percent of the 20 international and 24 national oil companies surveyed.

‘Reporting on Anti-Corruption Programmes’ refers to companies reporting their anti-corruption programmes according to the TI-UN Global Compact Reporting Guidance on the 10th Principle against Corruption.

‘Organisational Disclosure’ measures reporting of a company’s organisational structure, operations, partnerships and standards used for published financial accounts.

‘Country-level Disclosure for International Operations’ refers to companies’ reporting on meaningful country-level financial and technical data relating to their international operations.

pkfz port klang ong tee keat lee hwa beng paul low seng kuan pc 100609 02“The report aims to promote accountability in resource-rich countries by improving awareness of the importance of revenue transparency of major oil and gas companies,” TI Malaysia chapter chairperson Paul Low (right) said in a statement.

“Oil and gas producers generate and transfer considerable funds to national and host governments. Natural resources wealth can fuel large-scale corruption and mismanagement, if not properly managed.

“Transparent and accountable management of resources and revenues are fundamental to economic development and the public good."

Low said the report has highlighted the need for Petronas to significantly improve transparency and public disclosure.

“TI-Malaysia calls on Petronas to promptly heed and remedy the highlighted weaknesses.

“This is necessary to assure the public that national and international resources, of which Petronas is custodian, are being managed with transparency, integrity and good governance in the interests of Malaysia and its citizens."

Problematic aspects

Data for the study was based exclusively on publicly available information or documents.

The report finds that Petronas is not transparent in terms of the supply of goods and services to governments, and in procurement procedures.

azlanIt also reveals that Petronas is not a supporter of the Extractive Industries Transparency Initiative (EITI), a coalition of governments, companies, civil society groups, investors and international organisations that sets a global standard for transparency in oil, gas and mining.

“The EITI offers a simple mechanism to ensure the systematic disclosure and dissemination of information on payments and revenue from mining and oil and gas. Therefore, companies should join the EITI as a way to promote both corporate and government transparency,” reads the report. 

However, the report observes that compared with its 2008 study, many companies have begun publishing corporate documents relevant to their anti-corruption programmes. They included Petronas, which has published a new sustainability report.

“There are positive transparency trends in the oil and gas sector, although the overall level of reporting remains unsatisfactory,” concludes the report.

In a study by TI and RWI released last October, which referred to governments, Malaysia, by way of Petronas, also scored below average on transparency of revenue management.

Datuk Seri Anwar Ibrahim membuat kejutan kepada pengundi Dewan Undangan Negeri (DUN) Merlimau apabila mendedahkan salinan dokumen perjanjian antara Apco Worldwide dan kerajaan Israel yang ditandatangani pada 1991 – bukti pertalian erat kedua-dua pihak.

Ketua Umum KEADILAN itu turut membaca satu perenggan sebelum menyerahkan kepada jurugambar media tempatan yang berebut-rebut mahu merakam dokumen berkenaan.

"Tarikh dokumen ini bila? Tahun 1991. Apa berlaku pada 1999? Ehud Barrack (Perdana Menteri Israel) anjur kempen One Israel. Pada 2009 pula, (Datuk Seri) Najib (Razak) memperkenal Satu Malaysia.

"Pada 1999 juga, Ehud kemuka slogan 'People First', Najib pula 'Rakyat Didahulukan'. Kemudian, Ehud buat klinik untuk rakyat Israel. Najib buat apa? Klinik Satu Malaysia.

"Ke-be-tu-lan," sindir Anwar dengan disambut sorakan kira-kira 3,000 hadiri yang memenuhi lokasi ceramah di Merlimau Pasir di sini, malam tadi.

Anwar pada Disember tahun lalu digantung dari menghadiri sidang Parlimen selama enam bulan selepas mendedahkan persamaan slogan One Israel dan Satu Malaysia dengan mengaitkan peranan Apco, tanpa diberi peluang membela diri.

Turut digantung ialah Mohamed Azmin Ali (KEADILAN-Gombak), R Sivarasa (KEADILAN- Subang), dan Karpal Singh (DAP-Bukit Gelugor).

Kerajaan Malaysia sebelum ini, walaupun menafikan slogan Satu Malaysia hasil ilham Apco, mengaku membayar RM70 juta kepada firma perunding antarabangsa yang didalangi pemimpin Israel-Zionis itu.

Antara pegawai kanan Apco ialah bekas Duta Israel ke Jerman, Shimon Stein yang berkhidmat dalam kerajaan Israel dan berperanan penting dalam pentadbiran dua bekas Presiden Amerika, Bill Clinton dan Jimmy Carter, selain menjadi bekas ahli lembaga pengarah Yayasan Jerusalem.

Pegawai kanan lain ialah Itamar Rabinovich, bekas duta Israel ke AS dan Ketua Perunding Israel dengan kerajaan Syria ketika Yitzak Rabin masih menguasai kerajaan Israel.

Selain bukti itu, Anwar pada ceramah berkenaan turut membawa salinan dokumen laporan Global Financial Integrity (GFI) yang menunjukkan aliran keluar wang haram dari Malaysia sebanyak RM888 bilion (AS$291 bilion) dalam tempoh sembilan tahun sejak 2000.

Beliau berkata, jumlah itu menyamai wang yang dilarikan dua diktator iaitu bekas Presiden Tunisa, Zainal Abidien Ben Ali mahupun bekas Presiden Mesir, Hosni Mubarak selepas diguling rakyat negara masing-masing.

Anwar juga kesal kerana kerajaan Umno Barisan Nasional (BN) sehingga kini berdiam diri tanpa membuat sebarang siasatan, jauh sekali mengheret mereka yang terlibat ke muka pengadilan.

"Jika Pakatan Rakyat memerintah negara, kita akan menjalankan siasatan terperinci. Ini memalukan negara di mata dunia," katanya.

Laporan itu menunjukkan Malaysia berada di tangga kelima dari senarai panjang negara yang terlibat dalam pengaliran keluar wang secara salah seperti wang rasuah mahupun wang lari cukai.

Pada ceramah itu, Anwar turut mengulangi janji Pakatan Rakyat untuk menurunkan harga petrol sehari selepas menawan Putrajaya.

Malah, gaya beliau membuat pengumuman penurunan harga petrol mencuit hati hadirin yang menggamatkan suasana dengan bersorak, dikuti laungan takbir.

Selain Anwar, beberapa pimpinan Pakatan Rakyat termasuk calon PAS bagi DUN Merlimau, Yuhaizad Abdullah; Pengarah Komunikasi KEADILAN, Nik Nazmi Nik Ahmad; Ahli Parlimen Hulu Langat, Abdullah Sani; Ketua Penerangan PAS Pusat, Idris Ahmad dan Ahli Parlimen Kota Raja, Dr Siti Mariah Mahmud turut menyampaikan ceramah.

Karpal: Anwar Treated Like An Animal During Lockup

Datuk Seri Anwar Ibrahim’s lawyers claimed today that their client was detained under squalid conditions during an overnight stay at the Kuala Lumpur police headquarters in 2008.

Anwar (picture) was arrested on July 16, 2008 and was brought to the KL police headquarters where he spent the night in a lockup cell, and was released at 12.30pm the next day.

"The lockup is like being in an animal barnyard (kandang binatang.) Can you confidently say that even the toilet, is it in good condition?" said Karpal during cross-examination of DSP Yahya Abdul Rahman today.

The policeman, who had escorted Anwar that night to the lockup along with investigating officer DSP Jude Pereira admitted the conditions of the holding cell was far from satisfactory.

He however attributed the poor conditions of the lockup to the entire condition of the police headquarters.

"Its an old building…that is why it was not in satisfying condition," said the witness.

He also claimed to have forgotten who had instructed him to put Anwar in the lockup.

Karpal: who ordered you to put Anwar in lockup?

?Yahya: I'm not sure…Jude and I we were both ordered by our superiors.

Yahya also testified that the close-circuit television in the lockup area had not been functioning for a "long time" and had been that way ever since he began working there.

Yahya had been attached with the KL police headquarters since February 23, 2008.

Anwar's lawyers wasted no time in attacking the police officer, claiming that Anwar's health concerns were not addressed during his overnight detention.

"So no bed, nothing? That is standard for lockups nationwide? You knew he had back pain, but did not supply (him) with blankets," shot Karpal from across the courtroom.

Yahya in turn calmly responded that it was standard practice for all police lockups and that no lockups in Malaysia issued pillows to detainees.

The trial will resume again this afternoon.

The complainant in Anwar's sodomy trial, Mohd Saiful Bukhari Azlan had complained that Anwar had sodomised him at a luxury condominium in upper-class Bukit Damansara here on June 26, 2008.

Saiful, now aged 25, has never named anyone else.

Anwar, the 63-year-old PKR de facto leader, is currently facing sodomy charges for the second time in his life.

He has denied the charge, describing it as "evil, frivolous lies by those in power" when the charge was read out to him.

He is charged under section 377B of the Penal Code and can be sentenced to a maximum of 20 years' jail and whipping upon conviction. The trial is taking place 18 months after Anwar was charged in court in August 2008.

He was charged with sodomy and corruption in 1998 after he was sacked from the Cabinet and was later convicted and jailed for both offences.

He was freed in September 2004 and later resurrected his political career by winning back his Permatang Pauh parliamentary seat in a by-election in 2008, which had been held in the interim by his wife.

He led the opposition coalition, Pakatan Rakyat, to a historic sweep of five states and 82 parliamentary seats in Election 2008.

London Protesters Want Taib’s Assets Frozen

Some 20 protesters comprising Malaysians and foreigners have staged a ‘Stop Timber Corruption’ demonstration in the British capital to highlight alleged abuses of long-serving Sarawak Chief Minister Abdul Taib Mahmud.

london protest against taib mahmud 5The demonstration, organised yesterday by NGO Bruno Manser Fund (BMF), was held outside a property company controlled by the Taib family, Ridgeford Properties Ltd, in central London.

It was led by Clare Rewcastle Brown, the sister-in-law of former British premier Gordon Brown, and Sarawak native Peter John Jaban.

Rewcastle Brown is the founder of the critical website Sarawak Report, which has been exposing Taib’s alleged corruption and global business empire.

Protesters unfurled posters with Taib’s portrait that said ‘Stop timber corruption in Sarawak’ and ‘Freeze Taib assets’.

Other posters read ‘Chief Minister of Sawarak – 30 years is enough!’, ‘Stop illegal logging on native lands’ and ‘Respect natives’ rights’.

A similar demonstration organised by BMF was held in downtown Ottawa, Canada, outside another property company controlled by Taib’s family – Sakto Corporation.

Last week, BMF released a list of 49 companies located across four continents around the globe, which it claims are linked to Taib and his family.

NONEThe intention of the blacklist is to help anti-corruption and anti-money-laundering authorities in the countries listed, to identify and freeze allegedly illicit assets accumulated by Taib and his family, the Swiss-based BMF said.

Following the release of the list, BMF launched an online petition on its website, calling on the authorities in the respective countries to investigate Taib and his family’s financial dealings and freeze their assets for subsequent restitution to the people of Sarawak.
