Does the Islamic world need an ‘Iron Fist’?

Posted: 19 Sep 2013 05:21 AM PDT

TMI

Thomas Friedman's piece in the New York Times on  September 7, 2013 on the subject of whether or not the USA should intervene in Syria was essentially based on the idea that "the Islamic world will never behave properly," a perspective we have been indoctrinated with for years.

Friedman cites examples from Iraq, Afghanistan, Libya and even Bosnia, suggesting that they have never managed to live together unless they have been ruled by "an iron fist." He then suggested that the peoples of these lands, which he regards as "people who are unlikely to develop a culture of co-existence as equal individuals," have only been kept under control by dictators.

Friedman basically said that "They start turning on one another as soon as the dictators depart." Sadly, there is an element of truth in what is an otherwise ignorant interpretation, to put it mildly.

The following expression in particularly throws one obvious fact in Muslims' faces: "The problem is not poisoned gas, but poisoned hearts…"

Leaving aside the accuracy of that analysis, if we look at Friedman's general take on the Islamic world we see that it reflects a perspective raised in various forms by figures such as Daniel Pipes. This is a patronizing perspective devoid of human values, that does not seek to understand and improve, but rather that calculates how to shape matters in its own interests.

It always reminds me of what the British did to the Australian aborigines at the beginning of the 20th Century. Just because they regarded them as different from themselves they put them in cages, transported them to their own country and displayed them in zoos.

The language frequently employed when speaking of Muslims suggests that they are referring to an "intermediate entity," rather than human beings with their own histories, cultures and traditions.

They offer analyses with laser pointers in their hands, taking great pains to avoid touching them as little as possible. In discussing the maps they place in front of them, they ignore the fact that those pieces of paper represent real places, and that there are human beings living in them. The result is dehumanized and ruthless ideas, devoid of any conscience.

The basic error made by Friedman and the like is that they are analyzing a vast tract of land in terms of a handful of radicals and they are unable to see that this path they consciously follow represents a dead-end for themselves as well as those living in that corner of the world.

No matter what the pretext, supporting repression, injustice, oppression and dictators condemns their own countries to live in a state of fear and alarm. It does nothing but encourage the radicalism they talk about all the time, and therefore violence.

The USA and the West will never find peace so long as they say, "even if Muslims living on the other side of the world fight one another and tens of thousands of people are killed by dictators, we are only concerned with our own interests."

The road to peace runs through cultural activities directed against radicalism and hatred, the very basis of radicalism. Muslims themselves must be united in that activity.

There are many lessons that Muslims need to learn from the current situation and stance. Unfortunately, Friedman is not completely wrong. There is no desire for a quality life in the Middle East as a whole. Existence is all most people ask for.

There can be no improvement and enrichment of life, and therefore the desire to preserve differences, without a search for quality. What is worse, anger, hatred and enmity flourish very quickly in these lands. Conflicts are easily stirred up.

Occupying forces are not currently killing Muslims in Iraq. It is Muslims who are doing the dying and killing; bombs explode in a Shiite district one day and a Sunni one the next. Muslims are also killing one another in Pakistan and Afghanistan.

There is bloodshed, pain and tears on every side. Yet when we look at the killers, we see familiar faces, not foreigners.

The Islamic lands that are today fighting one another were once the safest places even for Christians and Jews. Far from being hostile to Muslims, people of the same faith, and bombing their mosques, the people in these lands even repaired churches and synagogues by order of their caliphs. The love, broad-mindedness and tolerance in these lands laid the foundation for Western civilization.

Now, however, division, lust for power, a refusal to recognize the rights of others and bottomless rage have enfolded the region. It is easier to put that fire out than people imagine.

So as we are determined around love, patience and compassion, let us act in the light of conscience rather than "logic" and never stray from justice.

The salvation of the Islamic world lies in building a culture purged of superstitious nonsense that is democratic, modern, secular and loving and based on the loving spirit of the Quran that values women and is of high quality. In building that culture Muslims must not exclude the West, and the West must not look down on Muslims or disregard their peoples.

World peace can be established with a spirit that regards everyone as equal and that value and respects them. It is not enough for the radicalism in the Islamic world to be cured for that to happen:

The uncaring, selfish orientalist mentality left over from the 19th Century must also be cured. When we start that treatment with a rational, moderate, common sense and majority alliance, then we will see that the enlightened world for which we long is not as far off as we think.

Malaysia’s Multiracial Promise Marred by Bigotry and Political Persecution

Race-based incentives, crackdowns on opposition figures, and an exodus of non-Malays: how Malay supremacists are creating a divided and fearful society

Malaysia's opposition leader Anwar Ibrahim delivers his speech during a protest against recent election results outside Kuala Lumpur

Malaysia is fond of presenting itself as a beacon of multiculturalism, but intolerance and division are increasingly the hallmarks of this southeast Asian nation of just over 29 million.

The return to court on Tuesday of 66-year-old opposition leader Anwar Ibrahim — who has spent the last five years fighting "sodomy" charges that he insists are politically motivated, and now awaits the verdict of a government appeal against his acquittal in January — is the latest fissure in the nation's fractious politics. Others include the announcement of $9.4 billion worth of race-based incentives and a worsening climate of racial bigotry and hate speech that has seen Malaysia declared one of the world's least tolerant societies.

General elections on May 5 saw the incumbent National Front coalition government of Prime Minister Najib Razak returned to power by the narrowest of margins — 50% to 47% of the popular vote. This translated to 133 to 89 parliamentary seats due to the "first past the post" electoral system, alleged electoral irregularities and apparent widespreadgerrymandering.

The opposition Pakatan Rakyat (People's Alliance) coalition, led by Anwar, complained bitterly and tens of thousands took to the streets to demand an investigation. In response, several opposition figures were arrested amid a crackdown that saw democracy take "significant steps backward," according Bridget Welsh, an associate professor in political science at Singapore Management University.

Despite lauding itself as a democracy, Malaysia has been characterized by racial politics since 1971, when statutory privileges for the Bumiputra, or "sons of the soil" as the Malay and smaller indigenous minorities call themselves, were introduced in the wake of bloody race riots. Ethnic Malays make up roughly two-thirds of the population, but Malaysians of Chinese immigrant ancestry are generally wealthier and better educated. (According to Najib, they are 50% wealthier.)

On Sept. 14, statuary entitlements for secondary education, government-linked jobs, entrepreneurship and housing were increased for ethnic Malays at the expense of the Chinese and Indian population.  "[The government is] insisting on a racist agenda at the expense of the country," Anwar told TIME from the Court of Appeal in Kuala Lumpur. Najib, however, insists that the policy is fair. "We are doing what is right and we are doing what is equitable," he said upon announcing the move.

Curiously, Najib, an economist, previously described himself as a reformer who wanted to dial back Malay entitlement through his 1Malaysia drive, which championed ethnic harmony, national unity and needs-based instead of race-based assistance. The promises did not last long, however. "This guy has portrayed himself as a reformer of the highest level, but what he is actually doing is very much against reform," says Welsh.

Instead, Najib appears to be focusing on hardliner support, which he needs in order to avoid losing his job at the United Malays National Organization (UMNO) annual general assembly on Oct. 5. "Najib is in a contest with hardliners for the hearts and minds of his party," says Phil Robertson, deputy Asia director at Human Rights Watch. The Prime Minister's "complete turnaround," Robertson says, is due to his "fighting for his political life" after a disastrous performance at the ballot box.

The near unanimous opinion among economists is that racial entitlements for Malays come at a cost for the country. Reserving key posts for unqualified people, for example, simply drives talent away. One out of ten Malaysians with a tertiary degree migrated in 2000 — twice the world average — while 90% of Malaysian migrants to Singapore were educated Chinese. Currently more than one million Malaysians work abroad out of a voting population of around 13 million.

"Economic advancement and progress will suffer and we will lose competitiveness because of the brain drain," says Anwar. Last month, Malaysia cut its 2013 growth forecast from around 6% to as low as 4.5%. "Using the race card is not helping Malaysia but just family members and cronies," Anwar adds. "This is 2013 and nobody is questioning your right to help those who need help, but it should not be based on race."

The same Malay supremacist elites championing racial entitlements are also driving the charges against the opposition leader. "I can think of no other politician in Southeast Asia that's been more persecuted over the last ten years than Anwar Ibrahim," says Robertson. UNMO's motivations are plain. As the head of a coalition of secular, Chinese and Islamic parties, Anwar "is the one person that everyone agrees has the stature to step up and be a legitimate candidate for prime minister," Robertson explains.

The father-of-six was accused of consensual sexual relations with his political aide Mohammed Saiful Bukhari Azlan in 2008, but High Court Judge Mohamad Zabidin Diah ruled in January that the DNA evidence presented by the prosecution had not been handled properly and could have been tampered with. (Anwar was originally charged with forcible sodomy until the defense questioned how a man in his 60s with a history of back complaints could have overpowered a healthy 20-something.) Nevertheless, the government chose to appeal the acquittal, with the case described by Welsh as "flawed at best" and indicative of the "tragic comedy" that Malaysian politics has become.

"We saw this in the May election, we saw it with the arrests of people after the election, we saw this with the dismissal of both the electoral officials," says Welsh. Now, she adds, Malaysia's tragicomedy can be seen in "the fact that [the government appeal against Anwar] is even moving forward."

Erdogan Promotes Democratization Package

Posted: 18 Sep 2013 11:52 PM PDT

Al-Monitor

At Beyaz TV last week, I worked on preparing a program about the life of Turkish Prime Minister Recep Tayyip Erdogan. After a taping with him, we had an opportunity for a chat. I told the prime minister I was contributing articles to Al-Monitor, which has become an important website tracking the pulse of the Middle East. He was glad to hear it. We then spoke of the democratization package at the top of Turkey’s agenda these days. Erdogan and his associates see the package of reforms as the "second silent revolution," tackling a number of issues until now considered taboo and therefore unaddressed in the 90 years of the republic.

The democratization package, on which the Justice and Development Party (AKP) is putting the final touches, covers a range of topics while focusing on four main issues: the peace process with the Kurds and resolution of the Kurdish issue, the Alevi issue, solutions to the problems of non-Muslim communities and the injustices of the Feb. 28, 1997, coup. AKP staffers say the core of the reforms covers a range of injustices.

The package is expected to be disclosed by Erdogan at a news conference dedicated to introducing it. The final contents will be approved at a meeting of the government. In addition to the steps to be taken in the context of the peace process, others are expected to include anti-discrimination measures, punishment for hate crimes, lifting restrictions on head scarves and expanding the boundaries of the freedoms of expression and protest.

Another important part of the package concerns the elimination of practices that have drawn criticism from Europe and resulted in Turkey being indicted too many times at the European Court of Human Rights. In this respect, Erdogan hopes to reshape the Turkish legal system to conform with the criteria of the European court. The following democratization measures are among those expected to feature in the package.

  1. Names formerly in Kurdish and other local languages will be reinstated. For example, Tunceli, which suffered massacres in 1938, will be reassigned its original Kurdish-Alevi name of Dersim.
  2. It is intended that the Heybeliada Ecumenical Seminary will soon be reopened. There will also be additional measures related to the rights of non-Muslims.
  3. Legal status will be granted to cemevi, Alevi houses of worship, and with the status of centers of faith, entitled to obtain land, electricity and water on favorable terms.
  4. Injustices surrounding the Feb. 28 coup, including detentions, will be addressed.
  5. Some of Turkey’s reservations related to the European Council's Autonomy to Local Administrations charter will be removed.
  6. Mother tongues will be allowed in government service.
  7. There will be an independent police auditor established as well as a commission to fight discrimination. The village guard system will gradually be abolished.
  8. Banning political parties will not be allowed. A majority-vote system will replace the proportional electoral system, and political parties will receive treasury assistance according to their vote ratios. Barriers to campaigning in mother tongues will be removed.
  9. There is the possibility of putting dedes, Alevi religious leaders, on the state payroll.
  10. There will be no restrictions on apparel worn in public. The package will also present reforms related to head scarves in public offices.
  11. Hate crimes will be classified as such.
  12. The Gendarmerie General Command will be removed from the command of the chief of General Staff and placed under civilian control at the Ministry of Interior.
  13. Long-term detention without trial will be eliminated.
  14. Election thresholds said to have been removed from the package will actually be included. Three alternatives of 3%, 5% or 7% have been discussed. It is believed that the new threshold will be 5% or 7%, instead of the current 10%.
  15. The teaching of Kurdish will be allowed in private and public schools.

The reactions of Kurdistan Workers Party (PKK) leader Abdullah Ocalan and PKK-affiliated politicians to Erdogan’s proposals are of course of significance. Selahattin Demirtas, co-chair of the pro-Kurdish Peace and Democracy Party (BDP), responding to reports that the democratization package had been taken to Imrali prison for Ocalan to review, said, "Whether the package has been taken to Imrali or not is meaningless, mere speculation."

When asked by a reporter whether he will be traveling to Imrali, Demirtas revealed that delegations have not been able to visit Ocalan for 20 to 25 days. He said such meetings should take place every other week, and with larger delegations, but until now, the government has not allowed these changes. He later added, "We think a BDP delegation will be going to Imrali by Sunday at the latest."

Demirtas asserted that if the government consults with political institutions to get the opinions of the opposition and civil society organizations about the reform package, the final product would be improved and more comprehensive.

Asked if the BDP's views had been sought in drafting the reforms, Demirtas recalled that they had shared a 25-item list of reform proposals with the government and the public at the beginning of the second phase of the process. Demirtas said their demands covered not only the Kurds, but general problems of democracy in the country.

Demirtas said, "The government says it has been working on the package for a long time, but in an atmosphere of mystery and secrecy. All the key items are well known. We all know how democracy will come and what is missing. At the moment, the government is trying to shape its own political agenda before submitting it to the public agenda. Otherwise, why would they need weeks and months of nightlong deliberations to work on the package. When it is revealed, we will see what it includes, how far the demands are met, what is satisfactory? We will make our position known then.

Demirtas concluded, "This democratization package is very important for a lasting solution [to the Kurdish issue] and peace. For people of Turkey the most vital issue is that no young people have died in the mountains in the last ten months."

Najib and Pak Lah privy to Project IC, claims Anwar

Posted: 18 Sep 2013 11:49 PM PDT

Malaysiakini

Opposition leader Anwar Ibrahim has implicated a former and sitting prime minister for perpetuating the mechanism of Project IC, despite the covert operation being said to have ended in 1995.

Anwar said a "secretive" special task force which was responsible for the arbitrary granting of citizenship still exists under former premier Abdullah Ahmad Badawi, better known as Pak Lah, and current Prime Minister Najib Abdul Razak.

"I do not believe that they have been disbanded, therefore I do not understand why Abdullah and Najib have not been called (to the RCI)," he testified before the royal commission of inquiry (RCI) on immigrants in Sabah at the Kota Kinabalu court complex today.

"They would have better knowledge, purview and understanding by looking at the notes and minutes of the task force which is under the National Security Council (NSC)," added Anwar.

Anwar claimed that the recent handiwork of this task force was in Selangor, where it had illegally given citizenship to foreigners like in Sabah.

However, Anwar, too was put under the microscope as he was grilled about his apparent inaction against Project IC when he was deputy prime minister between 1993 to 1998.

Anwar defended himself, saying that the likes of Project IC and matters related to the Home Ministry were kept closely to Mahathir's chest even though he was one of his most trusted aides at that time.

"I must say, even for Mahathir's successors, when it comes to national security, they hold it close to their chests.

"All those years I was deputy prime minister, I had nothing to do with the Home Ministry except to attend Quran readings and launching police stations in Perlis and Permatang Pauh," he said.

Furthermore, he said Sabah leaders at the federal level during that time also did not press on the issue and therefore it was never seriously taken up by the cabinet.

It was only later when local Sabah leaders complained about the influx of immigrants did he take notice of the problem, but even then did not understand the seriousness of it, Anwar conceded.

'I would have done more'

"I would humbly admit that I would probably had done something more had I been made aware of the gravity of the problem at that time," he said.

Former Chief Judge of Sabah and Sarawak Steve Shim, who leads the RCI, also grilled Anwar on the perception that Project IC was intended to alter Sabah's demography and paved the way for Umno's creation in the state.

Anwar, who was then an Umno vice-president, admitted that he was amongst the leaders tasked to set up Umno in the state in 1991 but said the entire party should not be faulted for Project IC.

"You have to differentiate between a political party fighting a legitimate battle within the bounds of the constitution, and illegitimate means.

"I don't believe it is entirely fair to blame the party as a whole because the operation was very secretive.

"Probably it was only among certain party leaders who continued to support or condone the excesses and illegal means, and they should be held responsible," he said.

Anwar said that Umno should reveal the record of its supreme council meeting minutes and go on record over the matter.

Anwar: Tidak munasabah Dr Mahathir tidak tahu Projek IC

Posted: 18 Sep 2013 11:44 PM PDT

TMI

BUKAN MAHATHIR SAJA SALAH

Syria: Accidental Diplomacy in the Devils’ Playground

Posted: 18 Sep 2013 03:20 AM PDT

Huffington Post

It’s unfortunate that diplomacy has now become an accident of U.S. foreign policy. After John Kerry’s slip-of-the-tongue in London last week, warmongers in and outside the beltway are sulking at the idea that a peaceful solution might prevent them from going to war in another Middle Eastern country.

Washington politicians’ chagrin at the prospect of a peaceful resolution makes one thing very clear: they do not care about chemical weapons, they do not care about dead children, and they do not care about Syrians, period. If they did, they might have themselves put forth the fairly unimaginative proposal that Syria give up its stockpile of chemical weapons. They might have not helped to nurture the Islamist insurgency that has hijacked what was once a national struggle for democratic reforms. And they might have put their weight behind a peace plan before the death toll topped 100,000, with a third of the country now refugees from their own land.

Let’s also not forget that the U.S. has always had a love/hate relationship with chemical weapons, looking the other way when its former client, Saddam Hussein, gassed tens of thousands during the Iraq-Iran war (including 10,000 innocent Iraqi Kurds in Halabja); White House officials similarly ignored the use of white-phosphorous, an incendiary chemical weapon, by Israel in Gaza in 2008; and then of course there is their own use of depleted uranium during the Iraq invasion.

So what is motivating this policy of “If you don’t stop gassing civilians, we will bomb your civilians”? We keep hearing on cable news that if the U.S. doesn’t attack Syria, the Iranians may continue to work on their dramatically overhyped nuclear weapons program. But this is a rhetorical feint, meant to obscure a much more grim reality: that Syria is only an appetizer for a much more destructive campaign against Iran, initiated by Israel and destined to be executed by their praetorian American backers.

After all, most of the jihadist forces fighting the Syrian government are not better than the current, odious regime of Bashar Al-Assad, and the U.S. and Israel know it. And so what they strive for is not the downfall of Assad, but a state of perpetual chaos in Syria. This is perhaps why Alon Pinkas, former Israeli consul general in New York, was quoted by theNew York Times as saying: “Let them both bleed, hemorrhage to death: that’s the strategic thinking here. As long as this lingers, there’s no real threat from Syria.”

Humanitarian motives indeed. But threat to whom? Prior to the uprising, the Golan Heights, occupied by Israel, were rather quiet for some time. So perhaps the better question is, threat to what? Some may argue that what is “threatened” by a stable Syria is the plan to attack and destabilize the Assad regime’s Shia patrons in Iran, a nation which lives in the crosshairs of the United States and Israel, and whose leaders use the threat of foreign attack as justification for a militarist fundamentalism of their own.

Much like Obama, Vladimir Putin is not concerned with the loss of Syrian lives. His interests lie in the billions in arms agreements that his government has with Assad. The Gulf monarchies — Saudi Arabia and Qatar — along with Israel and the United States, are interested in alienating Iran. Each of these players continues to make a terrible situation worse by throwing more bombs and guns into the mix, splashing fuel onto a fire with one hand while shaking their sanctimonious fists with the other.

And so the geo-political power games continue, with indisputably bad people on every side surrounding average, innocent Syrians who live under constant threat of death from all parties involved. Back in 2012 I made a film to highlight the plight of Syrian refugees caught in the middle of what one little girl I spoke to referred to as a “soccer match,” with Syria as the ball. The title of that film, The Suffering Grasses, was taken from the following proverb: “When elephants fight, it is the grass that suffers.” With over 100,000 dead and counting, and the entrance of the biggest elephant of all into the fray, this phrase couldn’t be more apt.

Given that ethical concerns are a low priority for the U.S., one would hope that rational self-interest might play some role in their decision-making when it comes to Syria. But the primary financial beneficiary of a U.S. strike on Syria (aside from the jihadists fighting Assad and the hemorrhage-happy Israelis next door) will be Russia. As oil prices invariably rise with a U.S. strike, Russia — the world’s largest exporter, along with Saudi Arabia — will be the first to profit from skyrocketing oil prices.

Then of course there are the direct costs of war. A single Tomahawk missile costs roughly $1.4 million. Experts have predicted that, putting together the costs of munitions, refueling, and keeping naval vessels within striking distance, even a “limited” cruise missile strike would end up costing U.S. taxpayers hundreds of millions of dollars. Given the slow recovery from the 2008 financial meltdown, and another one likely on the horizon, one would think that American leaders would think twice about spending taxpayer money to assist an opposition that includes al Qaeda in its ranks.

The American people, scarred by lies and fatigued from wars that have profited them nothing, came out in massive opposition to Obama’s “punitive” bombing of Syria. It seems they are coming around to the idea that there is no such thing as a humanitarian bombing, and that such conditions for war bring only more war. They are beginning to recognize that, like the slaughtered innocents of Syria, they too are grass suffering under the weight of elephants.

In the end, accidental diplomacy is better than no diplomacy at all. So we must continue to put pressure on our elected officials to move in this direction and to use negotiations over chemical weapons as an opportunity to bring all the major stakeholders — the Assad regime, the opposition, the United States, Russia, Turkey, Saudi Arabia, Qatar, and Iran — into further diplomacy that could end the civil war in Syria. Such intervention does not involve more weapons or bombings, but rather brings a framework for ending the violence and moving towards the peaceful democracy that the Syrian people rightly deserve.

Sodomy appeal VERY IMPORTANT TEST for M’sian courts, say int’l observers at Anwar hearing

Posted: 17 Sep 2013 09:45 PM PDT

Malaysia-Chronicle

The lawyers for Opposition Leader Anwar Ibrahim sprang a surprise on Tuesday, calling for one of the three judges hearing the government’s appeal of his sodomy acquittal to be recused.

According to Nurul, who is Anwar’s oldest daughter, the defense will also proceed to seek the removal of Umno lawyer Shafee Abdullah, who was specially appointed by the Attorney-General’s Chambers to lead the prosecution.

“The request was made by our counsel for one of the judges to be recused because she was involved in a past case together with Datuk Seri Anwar and Dr Mahathir Mohamad,” MP for Lembah Pantai Nurul Izzah Anwar told Malaysia Chronicle.

“We (will) try, somewhere in time it is the government’s loss because it leave a distasteful mark in the conduct of the case which is why we have so many observers because people are concerned there’s political motivation that influencing the progress of the trial. It is incumbent on the BN government to ensure that the Attorney General’s Chambers chooses proper individuals to raise the levels of professionalism and of course fairness,” she added, when asked if the bid to recuse Shafee would continue.

After deliberating for about half-an-hour, the 3-member panel agreed that Tengku Maimum Tuan Mat should be replaced and adjourned proceedings till the next day. A new judge will be named to take her place.

Anwar, sporting heavy dark glasses due to an eye irritation, declined to speak with reporters, saying that he would do so when the case had progressed further. Apart from Nurul, he was accompanied by PKR president Wan Azizah Wan Ismail, MP for Wangsa Maju Tan Kee Kwong and PKR vice president Chua Jui Meng.

Sorting out the problems: Shafee, next on the list

All eyes are next on Shafee Abdullah, the Umno lawyer who boasted that he could nail Anwar in “2 to 3 hours”. The new Appellate panel will hear the submissions of Anwar’s defense team led by veteran legal eagle Karpal Singh on Wednesday.

“That would be our main goal, the recusal of Datuk Shafee, but we need to cross this bridge first, to sort out who the problem is, who the judges are,” Ramkarpal Singh, one of the other lawyers told Malaysia Chronicle.

Rare scene of international support

It was a rare scene at Malaysia’s Palace of Justice where members of the legal academia, both foreign and local, nearly matched the number of supporters and media present.

“We are extremely comforted by the fact that the international community is taking a deep interest. Anwar having been acquitted, they had hoped this would be an end to a very sad tale. Now they (Prime Minister Najib Razak’s government) have taken this up to the Court of Appeal, the international media, the international community is still very interested in what happens to Anwar. We all know Anwar won the majority, with the Pakatan Rakyat winning the majority of votes yet they were denied setting up a government. Now they (Najib’s government) are pursuing this prosecution with great vigor with chief prosecutor saying, give him 2 to 3 hours and he will wrap up the case,” PKR vice president Chua Jui Meng told Malaysia Chronicle.

“So the presence of the international media and observers is very important to the course of reformation in this country, the course of change and we have 5 very distinguished bodies here (in court). We have the International Commission of Jurists which is represent by a very eminent jurist, Elizabeth Evatt, then we have the International Federation for Human Rights based in Paris, represented by Elizabeth Stoddard, is the foremost human rights body in the world. They are responisble for establishing the International Court in Hague. LawAsia is also present represented by Mark Trovell QC, who is also represent the International Parliamentary Union which represents 162 Parliaments in the world. They are here to see what is happening. Then we have the International Bar Association representing jurists and lawyers throughout the world with Edward Craven representing them. The last one is of course the International Legal Center in Philippines which has also sent a representative. The (Malaysian) Bar Council is also present, we also expect Suhakam is present.”

Very important test case for M’sian judiciary

One of the distinguished observers Elizabeth Evatt said the appeal would be a “very important test” for the Malaysian judiciary and legal system which has been tainted by allegations that it was corrupt and easily influenced by the top politicians of the day.

Evatt, who was a former Commissioner for the United Nations Human Rights Commission, is representing the International Commission of Jurists.

Queen’s Counsel Mark Trowell, who sits on the LawAsia committee and is representing the International Parliamentary Union, declined to comment on Malaysian legal system but said he would be furnishing his report direct to the IPU, which he added would in turn issue its report on the conduct of the case.

“There’s quite a lot of people from NGOs from different countrie in the region and overseas because we view this as a very important test for the judiciary and legal system here,” Evatt told Malaysia Chronicle.

The 66-year-old Anwar has denied the sodomy allegations raised against him and indeed, the courts have acquitted him twice. The first time was in 2004, after he was forced to spend 6 years in jail, with the Malaysian apex court only freeing him after his political foe, former premier Mahathir Mohamad, had retired from government.

In 2008, just as Anwar had led the Opposition to its biggest-ever electoral win, Prime Minister Najib Razak was accused of taking a leaf from Mahathir and using the same ‘script’ to slap on fresh sodomy charges against Anwar. However, he was again acquitted by the court.

Anwar has accused Mahathir, Najib and their Umno party of maliciously using sodomy to destroy his political career. Not only is homosexual sex banned in Malaysia and punishable by up to 20 years jail, it is prohibited under Islam which is Anwar’s religion.

The Racist Khairy Jamaluddin

Posted: 17 Sep 2013 09:43 PM PDT

Malaysia-Chronicle

PKR vice president N Surendran, declared Khairy Jamaluddin in Umno's vulgar mouthpiece, Utusan, was purposely attempting to anger the Malays.

Khairy, the Umno Youth chief, attributed no motive to Surendran for this 'attempt'. In fact, Surendran was arguing on a point of constitutional law that Umno has been blatantly flouting, and Khairy was issuing a thinly-veiled threat in an attempt to silence him.

Institutionalized racism

Racism has become so institutionalized in Malaysia that many Umno leaders, Khairy included, consider it to be normal. They are shocked when their actions are described as racism. They do not at all like the label.

The NEP has been used by the Umno elite to enrich themselves, their families and their respective cabals.

There are so many of these worthies slithering around in the halls of Putrajaya, expecting to make millions for no effort in return, that there simply is no money left for the average Bumiputra.

He will have to make do with rhetoric and the occasional measly crumb, doled out grudgingly when the elections are nearing.

Duty-bound to serve all Malaysians

Any organization that is funded by the state, itself funded by the taxpayer, is duty-bound to serve all Malaysians.

Organizations like Mara, PNB, and the dozens of other bumiputra-only units exist in flagrant violation of the Malaysian constitution. They are symbols of the racist state that Malaysia has become.

The founders of Malaysia cannot have meant for the country to practise such blatant racism as was exhibited by Najib Razak in his speech last Friday. We are well on the way to becoming an international pariah nation, like Zimbabwe or apartheid-era South Africa.

Khairy Jamaluddin and his like have become so used to the daily racism practised in Malaysia that it has become the new norm for them. They are therefore surprised that anybody should comment on what has become standard practise.

This racism has pervaded all aspects of Malaysian life right up to the horrible recent case of children being made to eat in the shower area of a school toilet, with no action taken on the offending Headmaster.

Enriching the few

As for the GLCs being asked to hand out more contracts to bumiputras, without doubt such contracts will go to the usual Umno contractors.

This was the problem with the NEP. It enriched the few. The worst excesses of the NEP were clearly illustrated by the NFC case. This has not stopped Umno Women’s chief Shahrizat Jalil from clinging to power. Vampires do indeed walk the earth.

In any event, periodically handing out money does not make people richer. Building enterprises which continually generate income while providing quality products and services to its customers is what the bumiputras should be trained and mentored to do.

‘Bimbo boy’ Khairy

Khairy Jamaluddin should take a hard look at himself before he indulges in further such racist attacks. The Umno election is a poor excuse for his behaviour.

As for his amateur and self-serving attempts to interpret constitutional law, he has been contradicted by Tommy Thomas, Azmi Shahrom and Latheefa Koya, all in one day.

He might want to focus on the Malaysian sports scene, which remains, after 4 months of his 'leadership', an awful bloody mess. Or is that too about race?

[PRESS STATEMENT] Bangladesh ICT has made ‘mockery of international law’ – Defence

Posted: 17 Sep 2013 08:33 PM PDT

17th Sep

The Appellate Division of the Supreme Court of Bangladesh delivered its verdict today on Abdul Quader Mollah. Mr Mollah was convicted of five counts of Crimes Against Humanity by the International Crimes Tribunal in Bangladesh and originally sentenced to life imprisonment. Now the Bangladesh Supreme Court has allowed the retrospective application of the death penalty and the Appellant is now prevented from exercising any further appeal. This decision has been reached despite strong criticisms raised by several UN Special Rapporteurs earlier this year and a critical report issued by the UN Working Group on Arbitrary Detention last year describing the process as arbitrary and breach of international law.

In a statement to the media following the appeal judgment, the Bangladesh Attorney General stated that the right to review contained under the Constitution in capital cases would not apply, as the war crimes trial fell outside of the Constitution.
This decision over which the accused now has no further right of appeal or review is in clear breach of international law. It lends further weight to calls for the war crimes trials to be condemned and replaced by a credible, International Criminal Tribunal under the auspices of the United Nations.

Abdul Quader Mollah was convicted following a highly controversial trial in which the Presiding Judge was removed following the resignation of the disgraced Chairman as a consequence of the 'Skypegate' scandal. The defence were prevented from calling witnesses and the case was promptly closed by the Tribunal and rushed to judgment. Both the Tribunal and the Supreme Court have failed to apply the law as it stood in 1971 and took judicial notice of contentious facts that were not in evidence. The defence were also prevented on numerous occasions from having privileged communications with the accused. The countless defects in the trial process and the numerous errors in law were so severe that they invalidate the entire judgment and any conviction amount to a miscarriage of justice. It is deeply regrettable that the Supreme Court has failed to remedy these defects on appeal and has applied a law that is unconstitutional and in breach of international law.

The law as it stood at the time of conviction did not permit any prosecution appeal for a higher sentence. Yet the law was subsequently amended for the sole purpose of allowing retrospectively a prosecution appeal seeking the death penalty in this particular case. The amendment was passed following the PM's remarkable statement in parliament, as a result of mass demonstrations on the streets of Dhaka, that the tribunal judges should listen to 'the sentiment of the people.'
The defence also sought the recusal of two judges on the appeal. First, Justice Sinha was mentioned in the 'Skypegate' recordings as having promised the disgraced Tribunal Chairman a promotion if he convicted three accused before the end of 2012. Second, it was alleged that Justice Shamsuddin Chowdhury was appointed to the Appellate Division of the Supreme Court explicitly for the purpose of sitting on these appeals. The application for Justice Chowdhury's recusal was based on his attendance at a number of Awami League meetings and having demonstrated clear bias. This defence application was not upheld and the appeal proceeded.

Commenting Toby Cadman, Foreign Legal Counsel, said:
'The trial process has been shown to be nothing short of a political show trial aimed at removing an Islamist Political Party, suppressing the opposition and securing the next election for the present Awami League Government.
'The language of the trial judgment clearly demonstrates that it had little to do with individual criminal liability and more about demonising a political opponent.'

'What is clear from a number of damning disclosures by the international community and the media is the overwhelming evidence that reveals serious judicial and prosecutorial misconduct and the collusion of the Government with members of the judiciary and prosecution to bring about a desired result by convicting and executing leading members of Jamaat-e-Islami.

'It is deeply regrettable that the Supreme Court has failed to remedy the very serious defects in the trial process and has upheld a law that we consider to be in breach of fundamental rights.
'We have today filed an urgent appeal with the Special Rapporteur on Summary Executions and the Special Rapporteur on the Independence of Judges for urgent intervention.'

Commenting John Cammegh, Foreign Legal Counsel, said:
'Coupled with the Government's consistent pressure to ignore due process and deliver speedy convictions and prompt executions, the process has become a mockery of international law and undermines all major international instruments that protect fundamental human rights principles.

'Turning a blind eye to the injustice that is currently unfolding in Bangladesh is no longer an option. What is required now is unified and effective action to ensure that the trials of the accused before the Tribunal are suspended pending a fully independent, international investigation into the practice of the Tribunal, as well as senior members of the Bangladeshi Government.'
