Office and political duties

These last few days, I'm in a terrible rush. My political programmes become more heavier as the general election is coming nearer, yet, I have to do office duties with more responsibilities as my partner, my daughter-partner, is now in Australia doing her Master Degree.

In the morning, of course, I have to send my grand daughter, Aina Syazrin, to school. Her father, being a computer programmer, is always working outstation. Luckily, at this moment, her uncle is still on vacation and he takes the resposibility to send Aina to school. But that won't be long, because from next week onwards, he will either be off to Kota Bharu or Kuala Trengganu for a long duty also doing computer programmes. He will be there for 5 years

Although a partner of this legal firm of Suhaimi Tan Zamani and Rozilan, my entire responsibility in this firm is reduced to signing documents including cheques, the rest of the work will be executed by our staffs who are experienced to work independently and by our legal assistan

As far as the flow of works is concerned will not be affected in a declining manner because Surina has done everything to ensure that the volume will remain. The only thing is that some clients are comfortable with her especially knowing her skills in thos kind of works.

I have been a litigation and conveyancing lawyer since I left my government post. I was a legal officer attached to the office of Solicitor General before moving to the Judiciary to work as a Magistrate in Kuala Lumpur and Ipoh Magistrate Courts.

I left the Judiciary to work for Dewan Bandaraya Kuala Lumpur as a Legal Officer-cum-Superintendent of the DBKL Traffic Wardens in charge of DBKL traffic system. I was also the Officer in charge of the city's vehicle breakdown unit. I was made the Administrative Chief of the DBKL Traffic Unit. I left DBKL to work as an Advocate and Solicitor of my one-man firm under the name of Suhaimi & Co.

With no ending flow of works in the plentiful, I brought in my other lawyer friends into my firm and changed the firm's name into Suhaimi Khor Zulkifli & Chang to include the names of all my partners i.e. Mr James Khor, Zulkifli Amin and Matthias Chang.

To this date the firm of Suhaimi Khor Zulkifli & Chang remains one of the established legal firm in Kuala Lumpur. But in 1978 I decided to move to my own town, Temerloh and established a new enntity separate from the firm in Kuala Lumpur until this partnership of Suhaimi Tan Zamani and Rozilan was finally established, one of the oldest legal firm in Temerloh.

Since the last 5 years under the verbal agreement between the partners i.e. Surina Suhaimi and myself, I have stopped going to the courts and remained in the office for administrative works only.

If I were to be invovled once again in the court works I have to restudy again because court works require constant and consistent reading of legal books especially in the fields of evidence and procedures and to keep pace with the changing legal principles established during the course of court proceedings churned out by the highest court of the country i.e. the Federal Court.

Being in the field of legal activities taxes my time and I had very little time to concentrate in my political works, and I did my political works to the detriment of my legal works.

So it was agreed by my daughter-partner that I come occasionally to the office and I could spend the rest of my time doing political works.

That's what I did within the last 5 years, full time in politics, and occasionally coming to the office to ensure that works are being carried out efficiently by the lawyers and the staffs.

Now I miss my daughter very much. She is a smart girl, much smarter than myself as far as carrying out the legal duties as an administrator and as a lawyer.

However, my daughter will not spend more than five months in a row in Melbourne for her Master Degree. She did the study in a well-planned manner that she could dispose all of her subjects intervally until completion. It takes a little more longer time to complete her Master Degree but that's the way to do it.

By so doing, she could cut her costs of RM500,000.00 but by doing the way she did, the cost might well be the same, but broken up into interval payments of around RM50,000.00 per session to allow her to get enough fund to finance the studies.

I still feel that my responsibity is towards my political carrier not realising that my committment now is also towards the legal firm too. I have tried very hard to compromise my position as a lawyer and a politician, and until my daughter comes back in April 2012, my dilemma will always remain.


Mahathir's Grand Design

It sounds like something of a grand design from Dr Mahathir Mohamed when he warned Najib not to hold an early general election. According to him, the timing is not suitable for the Barisan Nasional to hold an early election dan Barisan Nasioan will fall crumbling if the election is held within this year or even next year.

Definitely, Najib has to make his own analysis based on reports prepared by all advisors concerned like the powerful Special Branch who at all time are alligned to the Barisan Nasional as if the institution is Barisan-owned. The other report that will be relied on by Najib is of the Military Inteligence, which is more reliable because the players therein do not play political games but their report is based mainly from their own independent investigation.

The other report that Najib has to rely on is from the Department of Information nationwide. Other factors will include political and economic analysis of the trend of people's mood.

Through Budget 2012, Najib tried to create a friendly political atmosphere to test the people's mood by budget handouts of goodies, and the goodies will be delivered as of the 1st day of January 2012. If the goodies are well accepted by the the people, that will be the first signal that the general election would be round the corner.

The other economic balance to test the people's mood is the rising cost of living. As it is now, high cost of living has already hit the country with souring prices of goods to a level unknown before in this country.

The country is now heavily indebted with local and foreign debts hit rocket high of more than RM430 billion.

The other factor is the uprising of the Felda Settlers. The government seems to be helpless to come to the aid of the Settlers in their demand for fair and equitable income and the abolition of their debts which are based on thin air.

Summonses by the Settlers seem to be never ending and up to now more than RM1.2 billion have been claimed by the settlers in respect of manipulations of their income by Felda.

And without explaining any reason for it, Felda borrows from KWSP hugh some of money to the tune of RM6 billion, for purpose unexplained.

Felda Global Ventures an investment arm of Felda has made tremendous losses in their investment overseas.

Isa Samad, the new Chairman of Felda, without any legal basis took over from Dato Zulkifli the chairmanship of the powerful Felda's Cooperative Society, the KPF Malaysia Berhad. And thus creating an atmosphere of aenmity between Felda administrators and their political bosses.

And thus Najib has to weigh the advvantages and the diadvantages and to make proper assessment as to whether there already exists a right atmospohere to hold the 13th General Election.

However, Mahathir has his own plan. He tries to inject fear into the thinking of Najib and UMNO leadership that should the election be held in the near future, Barisan Nasional will certainly not be able to form the next federal government.

He may be properly advised through channels known to him as he was deadly right that the 12th General Election was a risky venture when warnings were allerted that Barisan Nasional would not be able to clinge to the 2/3rd majority in Parliament and few state governments would fall to the opposition. It came to be true and became a night-mare to the BN Government.

But he may also churn out his own personal views to inflict fears merely to gain time to enable his son, Mukhriz to have sufficient time to climb up to the top ladder to become the unchallenged Deputy Prime Minister paving the way later to take over the helm of power.

He may now be playing a chest game of either backing Najib or Muhyideen depending on advantage that he may extract for the benefits of his son.

Najib is certainly making all the way for his cousin, Hishamuddin Hussein to take over from him to become the next Prime Minister and to sidepas the present Deputy Prime Minister. Age -wise Muhyideen is much older than Najib and would not be able to become the Prime Minister should Najib take more than 3 terms in the premier seat.

Mahathir has to take Muhyideen on his side if he wants his son to become Deputy Prime Minister with Muhyideen in the seat of Prime Ministership. By hook or by crook, this has to be his game, and his grand design and he may behaving a backing of his former heavy weight in the name of Mr Daim Zainuddin.

However, the country is losing political and economic grip both local and international, and Malaysia will not be able to compete with her Asian and Asean neighbours.

The Opposition in the country has hit tremendous power and up to now almost 80% of the urban electorate are solidly behind the opposition. A slide turn 4 to 5% of rural votes to the Opposition will mark an end to the BN coaliton rule.

Mahathir's or no Mahathir's grand design the people of Malaysia will definitely make their choice.

PACABA dan Sukarelawan untuk JDM Paya Luas

Sdr Razak Hussain, Timbalan Ketua PKR Cabang Kuala Krau, Sdr Srinivasan, Naib Ketua dan Sdr Syafei Deris (berbaju hitam), kelihatan dalam foto Sdr Razak sedang memberikan taklimat mengenai tugas-tugas yang akan dijalankan oleh PACABA didalam PRU-13 akan datang.


Penubuhan PACABA dan Sukarelawan untuk JDM Kg Paya Luas telah berjalan lancar pada malam tadi dengan Ranting PKR Kg Paya Luas menyediakan 12 orang PACABA dan kumpulan ini ditambah lagi dengan 6 orang PACABA dari Kg Mendoi dan 4 orang dari Kg Seboi.

Para Sukarelawan dari Kampong ini akan bertugas mulai sekarang untuk mendapatkan 100 batang buluh untuk tujuan memasang bendera di Kg Paya Luas ini.

Wartakan Tanah Komunal Orang Asal

Setelah kajian dibuat secara terperinci, bukan semua Negeri di Semenajung boleh melaksanakan pemberian geran kepada Orang Asal untuk kepuasan semua. Ini memandangkan bahawa sesetengah Negeri sudah kehabisan kawasan hutan yang luas.


Tetapi ini tidak menghalang tindakan mewartakan Tanah Komunal Orang Asal dan diwujudkan Rezab Orang Asal.


Tanah yang direzabkan untuk Orang Asal ini memberikan sempadan yang tetap dan kekal dan tidak boleh diceroboh oleh mana-mana pihak, dan sebarang pelanggaran keatas Tanah Rezab Orang Asal ini dikenakan kesalahan jenayah yang berat. Penceroboh boleh ditangkap dan ditahan dan didakwa dengan kesalahan jenayah di Mahkamah.


Tindakan mewartakan tanah komunal Orang Asal ini adalah lebih berkesan dengan sekadar memberikan geran tanah kepada mereka.


Walaupun didalam syarat kepentingan yang diletakkan didalam Suratan Hakmilik bahawa semua geran tanah yang didaftarkan diatas nama Orang Asal tidak boleh dijual kepada lain-lain orang selain daripada Orang Asal, tetapi sudah berlaku bahawa Orang Asal yang memperolehi geran di Negeri Selangor sudah mengambil tindakan menyerahkan tanah mereka kerana habuan bayaran daripada pihak-pihak tertentu dan mereka menggunakan instrumen Surat Kuasa Wakil (Power of Attorney) untuk menyerahkan tanah mereka kepada orang luar.


Surat Kuasa Wakil itu adalah tidak sah dilakukan untuk tanah Orang Asal seperti juga tidak boleh dilakukan keatas tanah Orang Melayu didalam Rezab Tanah Melayu disisi undang-undang, tetapi cara inilah yang digunakan oleh pelupus dan yang menerima lupusan itu.


Jika ini dilakukan maka sudah tentulah akan mengeciwakan pihak Kerajaan seperti SSelangor yang mengeluarkan geran kepada penduduk Orang Asal di Negeri itu.


Pandangan daripada badan-badan NGO Orang Asal didalam hal ini boleh membawa keberkatan. Badan-badan seperti JOAS tidak bersetuju dengan geran tanah diberikan secara individu kepada Orang Asal, tetapi mereka menuntut supaya tanah komunal mereka diwartakan dan dilindungi oleh undang-undang yang ketat keatas sebarang pencerobohan.


Didalam kawasan yang diwartakan itu, komuniti Orang Asal akan melakukan cara-cara penggunaan tanah dengan tidak perlu mengeluarkan geran tanah agar semua tanah didalam kawasan warta itu akan terus menjadi hak Orang Asal dan tiada siapa yang boleh menjual atau menggadai tanah komunal yang diwartakan.


Diatas sebab-sebab itu juga mereka tidak bersetuju dengan Akta 134 yang mahu mengeluarkan geran tanah kepada Ketua Isi Keluarga dibimbangi bahawa akhirnya tanah yang dimiliki oleh Orang Asli yang diberikan geran akan kehilangan dari tangan mereka dan dikuasai oleh orang luar yang bukan Orang Asli dengan menggunakan pelbagai instrumen penukaran tanah walaupun instrumen itu tidak sah dari sudut undang-undang.


Walaubagaimana pun ada juga pandangan daripada sesetengah NGO mengatakan bahawa mereka menuntut semua tanah komunal mereka diwartakan dan mana-mana tanah Orang Asal yang sudah dimajukan oleh mereka untuk tapak rumah dan ladang boleh diberikan geran tanah. Mereka berdalil bahawa tanah yang telah mereka majukan itu tidak akan terlepas tangan daripada mereka memandangkan bahawa tanah-tanah itu mereka telah kerjakan sendiri dengan titik peluh mereka dan selama ini mereka tidak pernah melakukan untuk melepaskan tanah mereka itu kepada orang-orang lain.


Diatas dua pandangan ini maka wujud suatu persetujuan untuk kes-kes tertentu bahawa semua tanah komunal Orang Asal hendaklah diwartakan tertakluk kepada kehendak penduduk bahawa mana-mana diantara mereka yang berhajat untuk mendapatkan geran tanah bagi tanah-tanah ladang dan kampong yang sudah mereka kerjakan boleh dikeluarkan geran tanah.


Negeri-Negeri yang masih luas dengan tanah hutan yang mengelilingi kawasan penempatan Orang Asal boleh mengambil tindakan untuk mewartakan tanah komunal mereka dan didalam kawasan tanah yang diwartakan itu boleh mengeluarkan geran tanah seperti yang dikehendaki.


Tetapi keadaan seperti Negeri Selangor nampaknya amat sukar untuk mengambil tindakan seumpama itu memandangkan tanah hutan di Selangor sudah amat kekurangan, tetapi untuk perlindungan Orang Asal, Selangor juga boleh mewartakan tanah komunal orang Asal dan didalam kawasan tanah yang diwartakan itu terserah kepada kebijaksanaan Orang Asal untuk tanah-tanah itu dipergunakan untuk kepentingan Orang Asal yang tinggal didalam kawasan Warta tersebut.


Suatu perbincangan khas dengan NGO-NGO Orang Asal akan dibuat oleh Biro Masyarakat Felda dan Orang Asal untuk membuat satu dasar yang lengkap agar pihak Kerajaan Pakatan Rakyat nanti akan dapat melaksanakan dasar tanah yang bersesuaian dengan kehendak dan aspirasi Orang Asal dengan mengambil kira keluasan tanah yang ada di sesetengah Negeri dan keperluan mengeluarkan geran tanah.


Dengan perbincangan awal yang diambil, maka tidaklah menjadi satu kesusahan kepada Kerajaan Pakatan Rakyat untuk menyelesaikan dasar tanah Orang Asal dan sekali-kali tidak mengambil masa yang panjang seperti apa yang dilakukan oleh Kerajaan UMNO/BN sehingga 54 tahun pun masih belum dapat menyelesai masalah tanah Orang Asal.


Orang Asal memerlukan penyelsaian masalah tanah mereka didalam jangka yang cepat memandangkan bahawa tanah-tanah yang dulunya dikatakan tanah Rezab mereka sudah diceroboh oleh pelbagai agensi kerajaan dan swasta untuk memajukan tanah tersebut tetapi tidak memberikan apa-apa menfaat kepada Orang Asal sendiri.


Suatu Manifesto khas akan dikeluarkan oleh Parti Keadilan Rakyat bagi memperjuangkan hak dan kepentingan Orang Asal berhubung tanah mereka, dan akan diselesai dalam masa terdekat ini.
