Pasukan Pendakwa Kes Anwar Bercempera

Pasukan pendakwa kes Liwat II terhadap Datuk Seri Anwar Ibrahim bercempera ekoran dakwaan blogger Raja Petra Kamarudin, salah seorang anggota perempuannya mempunyai hubungan intim dengan saksi utama dan pihak yang mendakwa, Mohd Saiful Bukhari.

Ketua pasukan pendakwa itu, Solicitor-General 2 Datuk Mohd Yusof Zainal Abiden bagaimanapun belum dapat mengesahkan samada ada timbalan pendakwaraya wanita itu akan digugurkan atau tidak dari pasukan itu.

"Saya tidak boleh beritahu apa-apa sekarang, saya akan bincang dengan pasukan saya dan lihatlah nanti pada 2 Ogos sama ada dia masih dalam pasukan ini atau tidak,” kata Mohd Yusof sebagaimana yang dilaporkan oleh sebuah laman web.

Sementara itu, peguam Anwar, Sankaran Nair berkata, pihaknya akan menghantar surat kepada Pejabat Peguam Negara bagi mendapatkan penjelasan mengenai dakwaan Raja Petra itu.

“Kita akan hantar surat kepada pejabat AG hari ini, petang nanti mereka akan dapatlah surat itu,” kata Sankaran.

Pihaknya akan menunggu jawapan rasmi dari pejabat Peguam Negara sebelum membuat apa-apa tindakan yang sesuai.

Bagi beliau, jika benar dakwaan Raja Petra ini, ia merupakan satu yang sangat buruk dan ia akan menjadi lagi buruk kalau ia dibiarkan tanpa penjelasan yang wajar.

"Ini akan memberikan implikasi yang serius terhadap perbicaraan ini. Kami mahu Peguam Negara mengesahkan atau menafikan dakwaan ini. Kamar Peguam Negara perlu tidak berpihak dalam hal ini kerana Saiful adalah pihak yang membuat aduan dan saksi utama pendakwa,” kata Sankara.

Raja Petra dalam blognya mendakwa Saiful mempunyai hubungan sulit dengan salah seorang anggota wanita pasukan pendakwaan terhadap Datuk Seri Anwar Ibrahim.

Pemimpin kanan PKR, Peguam Sivarasa Rasiah mendakwa, beliau ada maklumat mengenai tuduhan ini.

Saiful sebelum ini membuat laporan polis diliwat oleh Anwar dan ekoran itu Anwar didakwa oleh pasukan pendakwa yang diketuai Yusof di Mahkamah Tinggi Kuala Lumpur.

Mohd Yusof mendakwa peranan timbalan pendakwaraya wanita itu hanya minima sahaja kerana dia tidak termasuk secara rasmi dalam pasukan pendakwaan beliau.

Wanita itu hanya dibawa masuk untuk membantu mengumpulkan data dan mengambil nota semasa perbicaraan kerana salah seorang anggota pendakwaan telah meninggalkan pasukan itu.

“Jadi, saya tidak boleh kata dia digugurkan dari pasukan ini, kerana dia bukan anggota pasukan ini sebenarnya, bukan macam (DPP) Noorin (Badaruddin), atau Wong (Chiang Kiat), atau saya. Dia dibawa untuk membantu tetapi sekarang kita sekurang-kurangnya ada tiga peguam yang boleh menyusun, dan kadang-kadang Noorin juga mengambil nota.

“Selin itu, dia (wanita yang dikaitkan) juga adalah pendakwaraya, peguam. Dia juga ada kes yang kena kendali. Jika kita putuskan tidak masukkan dia dalam pasukan kita bulan depan, ini kerana kita boleh kendalikan kes ini tanpa dia…juga kerana dia ada kes lain yang perlu diuruskan,” kata Mohd Yusof.

Anwar Demands A-G Respond To RPK’s ‘Affair’ Allegations

Datuk Seri Anwar Ibrahim's lawyers have demanded that Attorney-General Tan Sri Abdul Gani Patail respond to Raja Petra Kamaruddin's claims of a female deputy public prosecutor being romantically involved with the lead witness in Anwar's on-going Sodomy II trial.

Fugitive blogger Raja Petra Kamaruddin had alleged in a blog posting recently that a female deputy public prosecutor, a junior member of the prosecution team in Anwar's trial, is having an "affair" with lead witness Mohd Saiful Bukhari Azlan.

Lead counsel for Anwar's defence team Sankara Nair said that the Attorney-General or the prosecution team had yet to respond to Raja Petra's allegations, stressing that if the matter were left unaddressed, it could affect the on-going trial proceedings which is set to continue this coming August 2.

"This will have serious implications in the trial, we want the Attorney-General to confirm or deny these allegations. The Attorney-General's chambers has to be impartial and prove to do so in its dealings, even though Saiful is the complainant and the prosecution's material witness," Sankara told The Malaysian Insider this morning.

Sankara said that the defence team will be submitting a letter to the Attorney-General's office today, demanding that the Attorney-General step in and provide answers to Raja Petra's claims.

"We will be sending a letter to the Attorney-General's office today. They should be getting it (the letter) in the afternoon," said Sankara.

Sankara also said that they would have to wait for an "official response" from Abdul Gani before they can proceed with any further action.

But the prosecution team say that they are still undecided on whether the female deputy public prosecutor named by Raja Petra would be dropped when the case resumes next month.

Lead prosecutor for the case, Solicitor-General 2 Datuk Mohd Yusof Zainal Abiden, stressed that any decisions on whether she would still be on the team would only be made when the trial resumes.

Mohd Yusof refused to disclose her status following Raja Petra's allegations.

"I cannot tell you for now, I have not heard about these claims or allegations. But I will have to consult my team, and we will see on August 2 whether she will still be on the team," Mohd Yusof told The Malaysian Insider last week.

But the senior prosecutor insisted that her role in the case was minimal, as she was "not officially" part of the team when the trial commenced.

Mohd Yusof was also at great pains to explain that she had only been brought in to assist with compiling data and taking notes of trial proceedings because another prosecutor left the team.

"To begin with, she was not in my team. She is not a permanent member of the team… she was only brought in to help with taking notes, compiling data, evidence.

"So I cannot say that she's been dropped from the team, because she was well, not really part of the team, not like (DPPs) Noorin (Badaruddin), or Wong (Chiang Kiat), or myself. She was brought in to help out, but now we have at least three lawyers who can do the compiling, and sometimes Noorin also takes down notes.

"Besides this she (the implicated DPP) is a prosecutor, a lawyer. She also has other cases to handle. If we decide not to include her on the team next month, it's because we can handle it without her… it's because she too has other cases to manage," said Mohd Yusof.

Yusof has refused to comment on whether there was any truth to Raja Petra's allegations.

Anwar is being prosecuted by an eight men prosecution team comprising Mohd Yusof, Datuk Nordin Hassan, Mohamed Hanafiah Zakaria, Wong, Noorin, Mira Mirna Musa, Naidatul Athirah Azmad and Farah Azlina Latif.

Anwar, the 62-year-old PKR de facto leader, is charged with sodomising Saiful at Unit 11-5-1 of the Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara here between 3.01pm and 4.30pm on June 26, 2008.

The former deputy prime minister has denied the charge, describing it as "evil, frivolous lies by those in power" when the charge was read out to him. He is charged under section 377B of the Penal Code and can be sentenced to a maximum of 20 years' jail and whipping upon conviction. The trial is taking place 18 months after Anwar was charged in court in August 2008.

Anwar was charged with sodomy and corruption in 1998 after he was sacked from the Cabinet and was later convicted and jailed for both offences. He was freed in September 2004 and resurrecting his own career by winning his old Permatang Pauh parliamentary seat in a 2008 by-election.

He had earlier led the opposition coalition, Pakatan Rakyat, to a historic sweep of five states and 82 parliamentary seats in Election 2008.

Pelaburan Merudum: Najib Patut Berundur

Kejatuhan pelaburan langsung asing (FDI) sebanyak 81 peratus ke negara ini menghilangkan kelayakan Datuk Seri Najib Tun Razak sebagai Perdana Menteri dan Menteri Kewangan, kata Naib Presiden PAS, Datuk Mahfuz Omar.

Merudumnya pelaburan asing itu menunjukkan betapa buruknya tahap pencapaian Indeks Prestasi Utama (KPI) dan Bidang Keberhasilan Utama Negara (NKRA) Najib sebagai Perdana Menteri dan Menteri Kewangan, katanya.

“Dalam sebuah negara Perdana Menteri adalah Ketua Pegawai Eksekutuf (CEO) yang bertanggungjawab untuk membawa pulangan yang lumayan pada negara dari sejumlah wang yang telah dibelanjakan.

“Kejatuhan kedatangan pelabur asing sebanyak 81% telah menghilangkan kelayakkan Najib sebagai Perdana Menteri dan Menteri Kewangan.

“Najib seharus berundur secara terhormat demi untuk menyelamatkan satu Malaysia “rakyat didahulukan pencapaian diutamakan,” kata Ahli Parlimen Pokok Sena itu.

KPI dan NKRA diperkenalkan oleh pentadbiran Najib untuk mengukur adalah pencapaian dalam pengurusan.

“Dalam sektor korporat perkembangan begini adalah gambaran gagalnya seorang CEO. CEO seperti ini akan dipecat kerana tidak produktif dan gagal membawa pulangan keuntungan kepada syarikat. Kejatuhan 81% kemasukan pelabur asing adalah satu pencapaian buruk dan memalukan.

“Bersediakah Najib untuk berundur?

“Tentu tidak dan Najib akan kata business as usual. Inilah budaya ‘tidak apa’ Umno yang merosakkan negara,” kata Mahfuz.

Beliau melihat kejatuhan pelaburan asing yang begitu teruk itu adalah akibat dari gejala rasuah dan kepincangan sistem perundangan negara sehingga persepsi pelabur antarabangsa terhadap Malaysia begitu buruk sekali.

Menurut beliau, bagi pelabur asing, mereka akan melabur di tempat lain selain Malaysia apabila di Malaysia mereka berhadapan dengan rentetan birokrasi yang kronik dan juga terpaksa membayar tukang-tukang lobi yang mewakili ahli-ahli kabinet dan isteri serta keluarga mereka.

“Fenomena ini membawa kepada rasuah berleluasa. Di Malaysia Umno mengamalkan konsep who you know, not what you know. Kalau hendak kelulusan menteri, perlu bekerjasama dengan balaci-balacinya.” kata beliau.

Menurut beliau lagi, pelabur-pelabur asing juga tidak berminat kepada Malaysia apabila melihat kepincangan sistem perundangan dan keadilan negara.

“Kes Lingamgate, kes rampasan kuasa Umno Barisan Nasional (BN) di Perak, kes sodomi kedua dan lain-lain memberi gambaran law of rule bukan rule of law,” katanya.

Begitu juga dengan kepincangan pengurusan di Sime Darby, Felda, Maybank dan syarikat-syarikat berkaitan kerajaan (GLC) yang lain, kata beliau, kesemuanya memberi tanggapan buruk kepada pelabur-pelabur asing.

“Mereka melihat di Malaysia tidak ada budaya accountability dan responsibility.

“Sime Darby rugi berbillion, ahli lembaga pengarah masih ada, tidak ada sesiapa yang dikenakan tindakan undang-undang atau diberhentikan.

“Maybank buat pelaburan bodoh di Indonesia dengan membeli Bank Internasional Indonesia, CEOnya dilantik jadi menteri kabinet, sekarang jadi Pengerusi Majlis Penasihat Ekonomi Negara (NEAC). Felda susut rizab tunai berbillion ringgit, Najib terus jadi Perdana Menteri yang menguruskan Felda dan (Datuk) Ahmad Maslan terus jadi Timbalan Menteri.

“Mana dia accountability dan responsibility? Pelabur tidak akan melabur di negara yg tidak ada budaya accountability dan responsibility,” tegas beliau.

Laporan Pelaburan Dunia 2010 yang dikeluarkan oleh Pertubuhan Bangsa-bangsa Bersatu menunjukkan jumlah FDI ke Malaysia terus mencatatkan penurunan mendadak pada tahun lalu.

Jumlah itu berkurangan RM19.04 bilion berbanding RM23.47 bilion yang diterima pada tahun 2008 (Perangkaan diambil kira berdasarkan nilai US$1 = RM3.20650).

Perangkaan tahun lalu yang hanya bernilai RM4.43 bilion juga tidak mencerminkan separuh daripada apa yang lazimnya diterima oleh Malaysia pada 1995 hingga 2005.

Prestasi Malaysia juga dianggap memalukan jika dibandingkan dengan ekonomi Thailand dan Indonesia yang tidak mengecut dengan teruk di sebalik menerima tempiasan krisis kewangan dunia itu.

Thailand kehilangan RM14.24 bilion manakala Indonesia pula hanya berkurangan RM8.32 billion dalam FDI mereka, tahun lalu.

Kejatuhan mendadak itu yang dikatakan paling buruk dalam 15 tahun menyaksikan jumlah terkumpul FDI yang mengalir keluar melebihi jumlah pelaburan yang diterima sebanyak RM3.21 bilion.

Behind Exhumation of Simon Bolivar Is Hugo Chavez’s Warped Obsession

Upon Julius Caesar’s murder, a struggle erupted over who would control his legacy. Octavius, Caesar’s great-nephew, manipulated his position as Caesar’s heir to wrest power from his rivals. He made Caesar a god and raised a temple, using Caesar’s remains to underscore their connection. Symbolism was crucial, and to dispel any doubts about his legitimacy, Octavius added “Julius Caesar” to his name.

Shortly after midnight on July 16, Venezuelan President Hugo Chávez reached back in time. He presided at the exhumation of the remains of Simón Bolívar — Latin America’s greatest independence hero, who helped liberate the region from Spain in the 19th century, and the object of Chávez’s personal and political obsession.

The skeleton was pulled apart. Pieces were removed, such as teeth and bone fragments, for “testing.” The rest was put in a new coffin with the Chávez government’s seal. Chávez, who also tweeted the proceedings, gave a rambling speech in which he asked Christ to repeat his Lazarus miracle and raise the dead once more. He also apparently conversed with Bolívar’s bones.

“I had some doubts,” Chávez told his nation, paraphrasing the poet Pablo Neruda, “but after seeing his remains, my heart said, ‘Yes, it is me.’ Father, is that you, or who are you? The answer: ‘It is me, but I awaken every hundred years when the people awaken.’ ”

By presidential decree, every television station in Venezuela showed images of Bolívar in historic paintings, then images of the skeleton, and then images of Chávez, with the national anthem blaring. The message of this macabre parody was unmistakable: Chávez is not a follower of Bolívar — Chávez is Bolívar, reincarnated. And anyone who opposes or criticizes him is a traitor not just to Chávez but to history.

Legally, Bolívar’s body is in the care of the Venezuelan state, but his most immediate known kin were Pedro and Eduardo Mendoza-Goiticoa — the direct descendants of Bolívar’s youngest sister, Juana Bolívar y Palacios. Eduardo, my grandfather, died less than a year ago in Caracas. My great-uncle Pedro died last month at the age of 96. No attempt was made to notify him of the plan to open Bolívar’s tomb.

If you can imagine Washington, Jefferson, Madison and Lincoln rolled into one, you can appreciate Bolívar’s historical power in much of Latin America, and why a “Bolivarian ” revolution is infinitely more legitimizing than a “Chávez” revolution. Chávez’s aggressive appropriation of Bolívar — first politically and now physically — is especially meaningful because it is an attempt to wipe away the most important opposition leader and philosophical nemesis Chávez could ever face: Bolívar himself.

After his failed coup attempt in 1992 against Venezuela’s democratically elected government, Chávez, who had named his rebel movement for Bolívar, was imprisoned for two years and eventually received a presidential pardon. Upon running for office in 1998, Chávez dubbed his party the Bolivarian Movement, and as president he changed the name of Venezuela to include “Bolivarian Republic.” He has often left an empty chair at cabinet meetings, for Bolívar’s spirit, and even ordered the central bank to deliver Bolívar’s sword for his personal use. (He has since presented replicas to Moammar Gaddafi, Robert Mugabe, Alexander Lukashenko, Vladimir Putin, Raúl Castro and Mahmoud Ahmadinejad.)

Bolívar would be outraged by the notion of Chávez, a socialist, as his intellectual or political heir. In his correspondence, Bolívar revealed himself as someone in the company of Thomas Jefferson much more than Karl Marx (who documented his hatred for Bolívar in great detail). He described the American form of government — so disparaged by Chávez — as “the best on Earth.” The small library that accompanied him on his military campaigns included Adam Smith’s “The Wealth of Nations,” several biographies of George Washington and dozens of works on the rights of man and the tyranny of illegitimate government.

In language and thought, Bolívar was a student of the Enlightenment, and his struggle against Spain’s domination of South America reflected that inspiration. He was an admirer of the American Revolution, and his worldview was shaped by travels in Europe and by the works of Hume, Montesquieu and Voltaire. Bolívar understood that great nations are governed by laws, not men; liberalism, separation of powers, civil liberties, free trade and freedom of thought are recurring themes of his speeches and writings.

Chávez, in his personalization of power, assault on private property, stifling of dissent and destruction of the separation of powers, does not embrace Bolívar’s legacy. He represents its antithesis.

The idea to open Bolívar’s sarcophagus first surfaced in a 2007 speech by Chávez in which he suggested that the remains in the coffin were not those of Bolívar. At the time, a popular outcry against opening the coffin nixed Chávez’s curiosity, though not for long. As Chávez rattled sabers against neighboring Colombia, he publicly hypothesized that Bolívar had been killed by the Colombian “oligarchy.”

Enter Paul Auwaerter, Johns Hopkins medical school’s clinical director for infectious diseases. This year, Auwaerter, who enjoys diagnostic puzzles, presented findings at an annual conference analyzing the deaths of historical figures. He concluded that tuberculosis did not kill Bolívar in 1830; chronic arsenicosis did. A popular tonic at the time, arsenic was used frequently by Bolívar to treat fever spells.

The Chávez government seized on the news and began preparations to exhume the body. Auwaerter, who told me that his work was misconstrued, believes the available medical information supports chronic ingestion, not foul play. But Chávez says Auwaerter has provided proof of Bolívar’s murder.

I imagine that soon the government will declare that the investigation proves that Bolívar was murdered, either by Colombians or Americans or both. Indeed, I would not be surprised if the government announced that DNA evidence showed that Chávez is a long-lost relative of Bolívar!

For Chávez, this is not just an existential obsession, but possibly an electoral one. His main political opponent for the presidency is Leopoldo Lopez Mendoza, a cousin of mine and former municipal leader in Caracas whose approval in the polls exceeded 70 percent before the government arbitrarily disqualified him from running for elected office. The state-run media machinery frequently caricatures him as an unlikely relative of the Liberator, though Lopez has not made a public issue of his bloodline.

Chávez’s necromancy will not end with Bolívar. He has announced that he will exhume corpses of Bolívar’s family members and has promised to establish a new Bolívar mausoleum.

I hope that one day doctors convene a different conference, one to solve the puzzle of Chávez’s warped psychology. How sad that, at the same time that Chávez shows Venezuela Bolívar’s remains, Bolívar must endure what remains of his beloved Venezuela.
